hereinafter referred to as Owners, =>
whereby the former undertook and agreed to erect and construct a single family
residence on that certain lot of ground known as:
ALL THAT CERTAIN tract of land located in South Middleton Township,
Cumberland County, Pennsylvania, being showed as lot # 2 on a Final Minor
Subdivision Plan for Jason and Angela Baker, said plan being recorded in the
Office of Recorder of Deeds of Cumberland County, Pennsylvania, Instrument
Number 201010940 recorded April 30, 2010, being more fully bounded and
described as follows, to wit:
BEGINNING AT a monument on the south-right-of-way line of Lindsey Road and
land known as Lot #1, South 86 degrees, 46 minutes 25 seconds East, a
distance of 239.35 feet to an iron pin, and South 87 degrees 02 minutes 28
seconds East, a distance of 287.15 feet to a monument, and South 03 degrees
13 minutes 35 seconds West, a distance of 275.01 feet to an iron pin, and North
87 degrees 02 minutes 28 seconds West, a distance of 284.60 feet to an iron
pin, and North 86 degrees 46 minutes 25 seconds West, a distance of 241.90
feet to an iron pin and North 03 degrees 13 minutes 35 seconds East, a distance
of 275.00 feet to a monument and the Place of Beginning.
CONTAINING 144,790 square feet. (3.324 acres)
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 Dollar ($1.00) to
Contractor in hand paid by Owners, the receipt whereof is hereby acknowledged, and
the further consideration mentioned in the agreement aforesaid, for themselves and
their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto for or on account of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings
on the lot above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildings or
any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.
