ELECTION DISTRICT CUMBERLAND COUNTY AND NOW, comes the Cumberland County Board of Elections (Board), through its Solicitor, Edward L. Schorpp, Esquire and states the following: The Municipal Primary Election will be held on Tuesday, May 17, 2011. 2. The Municipal Election will be held on Tuesday, November 8, 2011. 2. On March 15, 2011, the Cumberland County Board of Elections received a letter from Hope Culley, the duly elected Judge of Elections for Upper Allen 4 election district, attached hereto and marked as Exhibit "A", stating that she is running for the office of Treasurer for Upper Allen Township and that her name will appear on the 2011 Municipal Primary ballot and possibly on the 2011 Municipal Election ballot in Upper Allen Township. 3. Section 2672 of the Pennsylvania Election Code, 25 P.S. § 2672, states, "...[N}or shall any election officer be eligible to any civil office to be voted for at a primary or election at which he shall serve, except that of an election officer". 4. The Board of Elections requests that Chad E. Foust, 3526 Rolo Ct., Mechanicsburg, PA be appointed to serve as Judge of Election for the Upper Allen 4 election district in the temporary absence of the duly elected Judge of Elections. WHEREFORE, the Petitioner, Cumberland County Board of Elections, by and through its Solicitor, Edward L. Schorpp, Esquire, respectfully prays that this Honorable Court enter an Order appointing Chad E. Pursuant to Section 2675 of the Pennsylvania Election Code, 25 P.S. § 2675, no appointment shall be made unless notice of the hearing to consider such appointment shall be provided to electors by the posting of such notice at the district polling place, and in the immediate vicinity, at least five days prior thereto. 5. The Board also requests the opportunity at such hearing to propose appointments in the event any vacancies in district election boards shall occur between the date of filing this Petition and the date of the hearing to be scheduled by this Court, provided the Board complies with the required notice described in paragraph 4.
