COMPLAINT IN CIVIL ACTION
AND NOW COMES, Plaintiff by and through its counsel, WELTMAN, WEINBERG & REIS,
CO., L.P.A., and hereby files this Complaint against Defendants jointly and severally. In support thereof,
Plaintiff avers as follows:
1. Plaintiff, Progressive Insurance Company ("Progressive"), is a corporation with a
registered office located at P.O. Box 43258, Richmond Heights, Ohio.
2. Defendant, Stan Deimler i/d/b/a Deimler Automotive, is an adult individual have one of its
places of business 110 State Highway, Enola, PA 17025.
3. Defendant, Mark Myers Enterprises, Inc., is a business organization licensed and
authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its places of
business 110 State Highway, Enola, PA 17025.
4. Progressive issued a policy of insurance where Progressive agreed to insure a boat, 1999
Oldsmobile Silhouette ("Insured Vehicle"), owned by Plaintiff's insured.

COUNT I - BREACH OF CONTRACT
5. On or about November 10, 2009, Plaintiff's Insured entered into a Contract with
Defendant, Stan Deimler i/d/b/a Deimler Automotive for automotive repair to the Insured Vehicle at
Defendant's location, for a fee.
6. On or about November 10, 2009, the Plaintiff Insured's vehicle was parked at Defendant's
business location, 110 State Highway, Enola, PA 17070.
7. On or about November 10, 2009, Defendant's business location caught fire, causing
damage to Plaintiff's Insured vehicle in the amount of $2,557.00.
8. Defendant had a contractual duty to insured the safety of Plaintiff's property.
9. Defendant failed to fulfill said duty and as a result owe damages to the Plaintiff.
10. As a direct and proximate result of Defendant's breach, the Progressive's Insured vehicle
sustained property damage in the amount of $2,557.00, plus rental costs in the amount of $360.00.
11. Pursuant to the terms and conditions of the insurance policy, Progressive paid the sum of
$2,917.00. A true and correct copy of the payment and damage and rental documentation is attached
hereto and marked as Exhibit "I".
12. Pursuant to the insurance policy issued by Progressive and as a result of said aforesaid
payment, Progressive became subrogated to the claim of its Insured against Defendants.
13. Pursuant to Progressive's right of subrogation, Progressive is presently due and owed from
Defendants the sum of $2,917.00.
14. Repeated demands have been made upon Defendants for payment of the aforesaid sum;
however, Defendants have willfully failed and refused to pay the sum due and owing to Progressive.

COUNT II - BAILMENT
15. On or about November 10, 2009, the Plaintiff Insured's vehicle was parked at 110 State
Highway, Enola, PA 17070, a location owned by Defendant Mark Myers Enterprises, Inc. and operated
by Defenant Stan Deimlber i/d/b/a Deimler Automotive
16. While the Plaintiff Insured's vehicle was under the exclusive and continuous care, custody
and/or control of Defendants, the Plaintiff Insured's vehicle was damaged when the building caught fire.
17. Defendants are liable to Plaintiff for all damages sustained by Plaintiff due to Defendants'
acts and/or omissions which consisted, inter alia, of. failing to have proper security at their facility; failing
to adequately insure the safety of the Plaintiff Insured's vehicle; permitting the Plaintiff Insured's vehicle
to be taken by a third person; permitting unauthorized third parties to access the site where the Plaintiff
Insured's vehicle was kept; failing to protect Plaintiff Insured's vehicle from damage and harm; and
failing to keep a proper lookout for the safety and security of the Plaintiff Insured's vehicle.
18. As a direct and proximate result of Defendants' failure to protect the Progressive's Insured
vehicle, Progressive sustained property damage in the amount of $2,557.00, plus rental costs in the
amount of $360.00.
19. Pursuant to the terms and conditions of the insurance policy, Progressive paid the sum of
$2,917.00. A true and correct copy of the payment and damage documentation is attached hereto and
marked as Exhibit "I".
20. Pursuant to the insurance policy issued by Progressive and as a result of said aforesaid
payment, Progressive became subrogated to the claim of its Insured against Defendants.
21. Pursuant to Progressive's right of subrogation, Progressive is presently due and owed from
Defendants the sum of $2,917.00.
22. Repeated demands have been made upon Defendants for payment of the aforesaid sum;
however, Defendants have willfully failed and refused to pay the sum due and owing to Progressive.
WHEREFORE, Plaintiff demands Judgment against Defendants jointly and severally the amount
of $2,917.00 and costs.

The Defense Manpower Data Center (DMDC) is an organization of the Department of Defense that
maintains the Defense Enrollment and Eligibility Reporting System (DEERS) database which is the
official source of data on eligibility for military medical care and other eligibility systems.
The DoD strongly supports the enforcement of the Service Members Civil Relief Act (50 USC App. §§
501 et seq, as amended) (SCRA) (formerly known as the Soldiers' and Sailors' Civil Relief Act of 1940).
DMDC has issued hundreds of thousands of "does not possess any information indicating that the
individual is currently on active duty" responses, and has experienced a small error rate. In the event the
individual referenced above, or any family member, friend, or representative asserts in any manner that
the individual is on active duty, or is otherwise entitled to the protections of the SCRA, you are strongly
encouraged to obtain further verification of the person's status by contacting that person's Service via the
"defenselink.mil" URL http://www.defenselink.mil/fag/pis/PC09SLDR.html. If you have evidence the
person is on active duty and you fail to obtain this additional Service verification, punitive provisions of
the SCRA may be invoked against you. See 50 USC App. §521(c).

More information on "Active Duty Status"
Active duty status as reported in this certificate is defined in accordance with 10 USC § 101(d)(1) for a
period of more than 30 consecutive days. In the case of a member of the National Guard, includes
service under a call to active service authorized by the President or the Secretary of Defense for a period
of more than 30 consecutive days under 32 USC § 502(f) for purposes of responding to a national
emergency declared by the President and supported by Federal funds. All Active Guard Reserve (AGR)
members must be assigned against an authorized mobilization position in the unit they support. This
includes Navy TARs, Marine Corps ARs and Coast Guard RPAs. Active Duty status also applies to a
Uniformed Service member who is an active duty commissioned officer of the U.S. Public Health
Service or the National Oceanic and Atmospheric Administration (NOAA Commissioned Corps) for a
period of more than 30 consecutive days.
Coverage Under the SCRA is Broader in Some Cases
Coverage under the SCRA is broader in some cases and includes some categories of persons on active
duty for purposes of the SCRA who would not be reported as on Active Duty under this certificate.
Many times orders are amended to extend the period of active duty, which would extend SCRA
protections. Persons seeking to rely on this website certification should check to make sure the orders on
which SCRA protections are based have not been amended to extend the inclusive dates of service.
Furthermore, some protections of the SCRA may extend to persons who have received orders to report
for active duty or to be inducted, but who have not actually begun active duty or actually reported for
induction. The Last Date on Active Duty entry is important because a number of protections of SCRA
extend beyond the last dates of active duty.
Those who would rely on this certificate are urged to seek qualified legal counsel to ensure that all rights
guaranteed to Service members under the SCRA are protected.
