NOTICE is hereby given that the United States of America
fried an indictment in the United States District Court for the --
Middle District of Pennsylvania, in the foregoing action. The United
States of America is seeking to forfeit the real property located at
1001-30 Nanroc Drive, Mechanicsburg, Pennsylvania, including all
appurtenances thereto, the legal description for which is as follows:
All that certain Unit designated as Unit 1-30, Building
I, being a Condominium Unit in Geneva Place, a
Condominium, located in Upper Allen Township,
Cumberland County, Pennsylvania, which unit is located
on the 2nd Floor, Building I, as designated in the
Declaration of Condominium, recorded October 5, 1983 in
the Office of the Recorder of Deeds for Cumberland Count-y,
in Miscellaneous Book 289, Page 929, and the Declaration
Plans, as recorded in the Office of the Recorder of Deeds for
Cumberland County, in Plan Book 44, Page 62.
Together all right, title and interest, being a .02083
percent interest in and to the Common Elements as more
fully set forth in the aforesaid Declaration of Condominium
and Declaration Plans.
Said Unit being known and numbered as 1001-30
Nanroc Drive, Mechanicsburg, Pennsylvania.
Under and subject to all agreements, conditions,
easements and restrictions of record and to the provisions,
easements, covenants and restrictions as contained in the
Declaration of Condominium, Code of Regulations and
Declaration Plans.
Being the same premises which William J. Bas/la and
Nancy L. Bas/la, granted and conveyed by deed dated July
21, 2003, unto Eric Atherton and Carol A. McCullough in
Book 258, Page 1392.
The Record owner of the defendant property is Eric
Atherton and Carol A. McCullough.
Title 21, United States Code, Section 853(k) states no party
claiming an interest in property subject to forfeiture may commence
an action at law or equity against the United States concerning the
validity of their interest after the filing of an indictment.
