HomeMy WebLinkAbout04-3735 TH S AG=EMENT made the /9 day , 2004, by and between (heleinafter referred to as "CONTRACTOR"), and CLEASON F. ZIM~4ERMAN and ROSANNE ZIMMERMAN,(hereinafter referred to as "OWNER"). The OWNER is acting as his own General Contractor concerning the construction of a chicken house on the hereinafter referred to property, and the OWNER AND CONTRACTOR have entered into an agreement (herein "AGREEMENT") whereby the CONTI{ACTOR umdertook and agreed to do the following work: the erection and construction of the building of OWNER's, which is situated on that certain lot of g~ou~d owned by OWNER and situate in Penn Township, Cumberland County, Pennsylvania, which is more particularly described in Deed dated June 10, 2004, and recorded in the office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, on June /~ , 2004, in Deed BookO~ , Page~ , which is incorporated herein by reference. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the CONTR3~CTOR, for and in consideration of the sum of ($1.00) Dollar to CONTRACTOR in hand paid by OWNER, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the above referred to Agreement between the parties, for CONTRACTOR and all of CONTRaCTOR's subcontractors (and all parties acting through or under them), covenants and agrees that no mechanic's liens or claims shall be filed or maintained by it or them or any of them a~ainst the building(s) and the lot of ground upon which the building is situated (as referred to above) for or on account of any work done or materials furnished by them or any of them under the Agreement or otherwise, for, towards, in, or about the repair or renovation or erection and construction of the building(s) on the lot referred to above, and the CONTR3tCTOR, for themselves, their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the buildings or lot, and agree that this instrument, waiving the independent covenant.
