LI"9'E~C, OOD, A sole hereinafter referred to as Contractor, , 2004, by and proprietorship, W~DALL E. LIV~N~KX~ AND I~ATNLEEN M. LIVENC~X)D, husband and wife, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Penn Township, Cumbe=la~d Count~, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as L~t 917 Ri~ner Highway, C&rlisle, C%~mberland Count~, PA. NOW ~FORE, THIS /~E~ENT WIT~SSRTH: That the said Contractor, for an in consideration of the sum o~ ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrur~ent, waiving the right of lien, shall be an independent covenant. ~T~SS our hands and seals the day and year first above written. Spencer, Jr. recorded in the Recorder of Deeds Office in and for Cumberland County, Pennsylvania in Plan Book 51, Page 115, more particularly bounded and described as follows, to wit: BEGINNING at a railroad spike in the centerline of L.R. 890 (Ritner Highway) at common corner of Lot No. 16 and Lot No. 17 on the aforementioned subdivision Plan; thence along Lot No. 16 South 31 degrees 22 minutes 55 seconds East 329.90 feet (passing through an iron pin set 29.90 feet from the aforesaid railroad spike) to an iron pin; thence continuing along Lot No. 16 North 58 degrees 37 minutes 05 seconds East 212.74 feet to an iron pin; thence along Lot No. 26 on said Subdivision Plan and a 50 foot wide private drive or right of way North 31 degrees 22 minutes 55 seconds West 260.00 feet to an iron pin; thence by a curve to the left having a radius of 40.00 feet, a chord bearing of North 76 degrees 22 minutes 55 seconds West, an arc length of 62.83 feet to an iron pin; thence North 31 degrees 22 minutes 55 seconds West 30.14 feet to a railroad spike in the centerline of L.R. 890 (Ritner Highway); thence over the centerline of L.R. 890, South 58 degrees 30 minutes 00 seconds West 95.13 feet to a railroad spike; thence continuing over the centerline of L.R. 890 South 58 degrees 35 minutes 15 seconds West 77.62 feet to a railroad spike, the point and place of BEGINNING.
