STIPULATION OF PARTIES
IN RE: PETITION TO STAY TRANSFER OF ESTATE ASSETS AND
TO DETERMINE ONNERSHIP OF TRANSFERRED FUNDS
Petitioner, the Estate of Peter Yandric, David P. Yandrich,
Executor, by and through Andrew C. Sheely, Esquire, Norma J.
Dieffenbach, Respondent, by and through counsel of Charles E.
Shields, III, Esquire, and Joan DiSante, also known as A. Joan
DiSante, by and through counsel of Hilary P. Vesell, Esquire,
hereby stipulate and agree as follows:
1. All funds, including interest accumulating thereon,
transferred on October 18, 2010 from decedent's Citizens Money
Market Account to a joint checking account owned by decedent and
Joan DiSante, also known as A. Joan DiSante, said funds
presently held by Citizens Bank in an Estate account, shall be
released to the Estate of Peter Yandric at no further claim or
demand of Joan DiSante, also known as A. Joan DiSante.
2. All funds, including interest accumulated thereon,
transferred from the decedent's wachovia Bank account by check
number 1201 dated October 1, 2010 in the amount of Fifty
Thousand dollars ($50,000.00) to a Metro Bank account owned by
Joan DiSante, also known as A. Joan DiSante, shall be released
to Joan DiSante, also known as A. Joan DiSante, at no further
claim or demand of the Estate of Peter Yandric, David P.
Yandrich, Executor, and Norma J. Dieffenbach, Respondent.
3. The Estate of Peter Yandric shall issue a check payable
to Joan DiSante in the amount of Fifty Thousand dollars
($50,000.00) on or before the date of this Agreement, and Joan
DiSante, also known as A. Joan DiSante, shall execute a receipt
and release waiving any and all claims and demands she may have
against the Estate of Peter Yandric and its fiduciary, David P.
Yandrich, Executor.
4. The Estate of Peter Yandric shall issue a check payable
to Joan DiSante in the amount of Five Thousand dollars
($5,000.00) in accordance with paragraph 2 of the decedent's
Last Will and Testament, and Joan DiSante, also known as A. Joan
DiSante, shall execute a receipt and release waiving any and all
claims and demands she may have as a beneficiary of the
decedent's Last Will and Testament against the Estate of Peter
Yandric and its fiduciary, David P. Yandrich, Executor.
5. The Estate of Peter Yandric shall assume and pay any
and all inheritance tax on the funds received from Joan DiSante,
also known as A. Joan DiSante, as set forth in paragraphs 2, 3

and 4 above, together with any and all inheritance tax
associated with the receipt of the remaining amounts held in a
joint Citizens Hank account with decedent in the amount of Nine
Thousand Seventy-Nine dollars ($9,079.00), and Frontier
Communications Stock transferred to Joan DiSante, also known as
A. Joan DiSante, on or about August 2, 2010 in the estimated
amount of One Thousand Three Hundred Two dollars ($1,302.00).
6. All parties shall assume their own counsel fees.
7. All parties agree to summit this Stipulation to the
Court for entry of a Final Order incorporating the terms set
forth herein.
This Stipulation and Agreement is hereby entered on the
dates set forth below.
