Whereas, Robert P. Hartzel, Jr. and Laura A. Hartzel
Of Meehanicsburg, Pennsylvania,
Is about to execute enntemporanenasly herewith, a contract with Home Designs Unlimited Of Pennsylvania,
For the erection of a two story frame building upon a lot of land situate
ALL THAT GERTAIN piece, parcel or lot of land situate in Hampden Township, Cumberland
County, Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Southeastern right-of-way line of Westbury Drive (50.00 feet
wide), said point being located at the Northwestern comer of Lot No. 72 of Phase V; then along
said right-of-way line, and through a 20.00 foot wide drainage easement, on the arc ora circle
curving to the right, having a radius of 125.00 feet, and an arc length of 91.55 feet, to a point;
thence along the same North 52 degrees 30 minutes 15 seconds East, for a distance of 69.27
feet, to a point at the comer of designated Common Open Space; then along said designated
Common Open Space South 37 degrees 29 minutes 45 seconds East, for a distance of 130.00
feet, to a point; thence along same South 42 degrees 29 minutes 19 seconds West, for a distance
of 56.76 feet, to a point at the Northeastern comer of Lot No. 72 of Phase V; then along the
Northern boundary line of said Lot No. 72, and along the centerline of a 20.00 foot wide
drainage easement, North 79 degrees 27 minutes 26 seconds West, for a distance of 145.00 feet,
to a point and the place of BEGINNING.
This piece, parcel or lot of land consists of approximately 15,035.23 square feet of land, and is
known and numbered as Lot No. 71 on the final subdivision Plan for Westhury - Phase IV,
which is recorded in Cumberland County in Plan Book 79, Page 89.
Now, 20 , at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said owners
To the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract
with Home Designs Unlimited and the further consideration of One Dollar, to
contractor paid by owners.
It is agreed that no lien shall be filed against the building by the contractor, or any
sub-contractor, nor by any of the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of said building, the
right to file such liens being expressly waived.
