HomeMy WebLinkAbout01-2082S TIP ULA TION A GAINS T LIENS THIS AGREEMENT made the 6th day of April, 2001, by and between RIDGEVIEW CUSTOM HOMES, LLC, hereinafter referred to as Contractor, and HERBERT G. WEAVER, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built home on that certain lot of ground situate at Lot No. 131, Indian Hills, South Middleton Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the fmther consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this insirument, waiving the right of lien, shall be an independent covenant. BEGINNING at a point on the northern side of Silver Maple Drive (a 50 feet wide right of way) at the dividing line between Lot No. 130 and Lot No. 131 of the aforementioned Plan; thence along said dividing line North 54 degrees 49 minutes 10 seconds West a distance of 167.91 feet to a point; thence North 20 degrees 11 minutes 44 seconds East a distance of 153.27 feet to a point at the dividing line between Lot No. 131 and Lot No. 132; thence along said dividing line South 37 degrees 49 minutes 53 seconds East a distance of 231.92 feet to a point on the northern side of Silver Maple Drive (50 feet wide right of way); thence along said Silver Maple Drive on a curve to the left having a radius of 285.00 feet a chord length of 81.83 feet and a chord bearing of South 45 degrees 14 minutes 57 seconds West to a point on the dividing line between Lot No. 130 and Lot No. 131, the point and place of BEGINNING. CONTAINING 21,658.90 square feet. LOT No. 131 is subject to all associated rights and provisions of a 30 feet wide Storm Drainage Easement. LOT No. 131 is subject to all applicable notations and conditions set forth by final subdivision plan approval of Indian Hills, Section No. II. EXHIBIT "A" 4
