DeLuca, Esquire who represents and avers as follows: 1. The Petitioner is Cumberland County Aging & Community Services, in and for Cumberland County, Pennsylvania, with its office located at 1100 Claremont Road, Carlisle, Cumberland County, Pennsylvania. 2. Lois J. Swanger, currently resides at Shippensburg Health Care Center, 121 Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania. 3. On August 13, 2010, a Petition for the Appointment of Permanent Plenary Guazdians of the Person and Estate of Lois J. Swanger was filed in the Orphan's Court Division of the Court of Common Pleas, in and for Cumberland County, Pennsylvania to No.21-10-0843 and on September 15, 2010, after hearing, Lois J. Swanger was adjudicated to be an incapacitated person and Cumberland County Aging & Community Services was 8ppointed Permanent Plenary Guardians of the Person and Estate of Lois J. Swanger. Prior to moving to Sluppensburg Health Care Center, Lois J. Swanger resided at 50 East Maim Street, Newville, Cumberland County, Pennsylvania. 5. Public records reflect that Lois J. Swanger and her mother, Julia Barrick, who is deceased, are the owners of the property at 50 East Main Street, Newville, Pennsylvania. A copy of said Deed is attached hereto, mazked as Exhibit "B", and incorporated herein by reference. 6. The mother, Julia Barrick, died on November 6, 2007 and, by operation of law, title to said premises vested solely in Lois J. Swanger. A copy of the Death Certificate for Julia Barrick is attached hereto, marked as Exhibit "C", and incorporated herein by reference. 7. The real estate presently sits empty but is in good condition. 8. The Cumberland County Tax Assessment for 50 East Main Street, Newville, identified as Pazcel No. 27-20-1756-088, is assessed at $155,500.00. A copy of the assessment is attached hereto, mazked as Exhibit "D", and incorporated herein by reference. 9. An appraisal of said property was conducted on November 24, 2010 by Diversified Appraisal Services of 36 East High Street, Cazlisle, Cumberland County, Pennsylvania and the fair mazket value was determined to be $135,000.00. A copy of the appraisal is attached hereto, mazked as Exhibit "E", and incorporated herein by reference. 10. The Petitioner believes and, therefore, avers that there are presently no mortgages or judgments recorded against said premises. 11. Cumberland County Aging & Community Services, the appointed Permanent Plenary Guardian of the Person and Estate of Lois J. Swanger believes and, therefore, avers that the sale of said real estate is in the best interest of the Estate of Lois J. Swanger and that the proceeds from said sale will be needed to pay for her continuing care at Shippensburg Health Care Center. 12. The Petitioner will engage the services of a realtor to sell the property. 13. Jane E. Adams, Esquire, the attorney who represented Lois J. Swanger in the prior Guardianship Hearing, has been advised that Cumberland County Aging & Community Services would petition the court to sell said real estate and Ms. Adams does not object to the relief requested by Cumberland County Aging & Community Services to sell the property. WHEREFORE, the Petitioner respectfully requests that this Honorable Court enter an Order directing the sale of 50 East Main Street, Newville, Cumberland County, Pennsylvania (Pazcel No.: 27-20-1756-088) owned by Lois J. Swanger, "AS IS - WHERE IS" with all faults and current conditions to an appropriate buyer and that Petitioner be authorized to execute any and all documents relating to the sale by signing as Guazdian of the Person and Estate of Lois J. Swanger is an incapacitated person in that she suffers from a mental impairment that prevents her from receiving and evaluating information effectively and prevents her from formulating and communicating decisions to such a significant extent that she is unable to manage her financial affairs or meet essential requirements for her physical health and safety on a daily basis. The Court appoints the Cumberland County Aging and Community Services, in and for Cumberland County, Pennsylvania, as Permanent Plenary Guazdians of the Person and Estate of Lois J. Swanger. Cumberland County Aging and Community Services shall be entitled to charge a fee pursuant to the fee schedule set forth in the Petition and, at such time as there are insufficient assets to continue payment of said fee, Cumberland County Aging and Community Services shall be entitled to receive a Guazdian fee subject to a maximum of 10% of Lois J. Swanger's gross monthly income or $100.00 per month, whichever is less, pursuant to Medical Assistance regulations.
