WHEREAS, Owner is about to execute contemporaneously herewith, a contract with Contractor for the renovation of commercial buildings situate in the Borough of Newville, Cumberland County, Pennsylvania, being known as 1 W. Big Spring Avenue., 7 W. Big Spring Avenue, 20 S. High Street and 22 S. High Street more fully described as follows: 1 West Big Spring Avenue, NewvillE - Tax Parcel #27-20-1754-186 BEGINNING at a point on Big Spring Avenue (formerly Railroad Street), four (4) feet east of a line parallel with the east side of a building now or formerly known as Literary Hall building; thence by said Big Spring Avenue, westwardly to a point six (6) feet west of the west line of said Literary Hall building extended or in all about fifty (50) feet; thence northwardly, seventy and one-half (70 1/2) feet, more or less, to lot now or formerly of H. S. and Stewart C. Graham (formerly of I. P. Ahl); thence eastwardly by said lot, fifty (50) feet to South High Street; thence southwardly by said South High Street, seventy and one-half (70 1/2) feet, more or less, to the place of BEGINNING. 7 West Big Spring Avenue, Newville - Tax Parcel #27-20-1754-185 BEGINNING at the western side of the lot on which the "Literary Hall" building stands on Railroad Street; thence along said Street, westwardly forty (40) feet to the lot of First National Bank of Newville building; thence along the lot of the First National Bank of Newville, northwardly seventy feet (70) to a lot of' John A. Ahl; thence eastwardly along said lot, forty (40) feet; thence along "Literary Hall" lot, southwardly seventy (70) feet to the place of BEGINNING. 20 South High Street, Newville - Tax Parcel #27-20-1754-188 BEGINNING at an iron pin on the building line on the western side of South High Street at the lands now or formerly of John McCrea, III, and Hamilton C. Davis; thence by the said land now or formerly of John McCrea, III, and Hamilton C. Davis, South 64 degrees 40 minutes West 99.05 feet to the base of a fence post at lands now or formerly of the First National Bank of Newville; thence by the lands now or formerly of the First National Bank of Newville, North 26 degrees 30 ,eCl'?f ?Sfla?1(? minutes West 25.99 feet to an iron pin; thence by lands now or formerly of the First National Bank of Newville, North 64 degrees 34 minutes 19 seconds East 99.71 feet to an iron pin at the western building line of the said South High Street; thence by the Western building line of the said South High Street, 25 degrees 4 minutes East 26.15 feet to an iron pin, the point and place of BEGINNING. 22 South High Street, Newville - Tax Parcel #27-20-1754-187 BEGINNING at a point on said High Street; thence westwardly by lot now or formerly of Mrs. H. Stough (now or formerly of the Farmers National Bank of Newville), 103 feet to lot now or formerly of the First National Bank; thence southwardly by said lot now or formerly of the First National Bank, 30 feet to lot now or formerly of St. Paul's Lutheran Church; thence eastwardly by lot now or formerly of St. Paul's Lutheran Church, 40 feet to corner of lot now or formerly of St. Paul's Lutheran Church and Literary Hall, now or formerly the Farmers National Bank Building; thence by the same, northwardly 4 feet 3 inches; thence by the same, eastwardly 64 feet to said High Street; thence by said High Street, northwardly 26 feet 2 inches to the place of BEGINNING. NOW, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Kenneth L. Tuckey for 3-T Investors, to the said TUCKEY RESTORATION, INC., to commence work on the said buildings, or purchase materials for the same, in consideration of the Owner making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the buildings by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
