HomeMy WebLinkAbout01-2272S TIP ULA TION A GAINS T LIENS THIS AGREEMENT made the 18th day of April, 2001, by and between BRYAN WEARY, hereinafter referred to as Contractor, and WILLIAM L. MOHN and SUZANNE M. MOHN, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built home on that certain lot of ground situate at Lot No. 7, Scenic View, Lower Mifflin Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Gutshall and lands now or formerly of Ray L. Deihl and Ann L. Deihl North 23 degrees 44 minutes 42 seconds East, a distance of 930.72 feet to an iron pin at lands now or formerly of Charles L. Bear and Helen R. Bear South 46 degrees 55 minutes 21 seconds East, a distance of 178.09 feet to an iron pin at a common property comer of Lot No. 5, Lot No. 6 and Lot No. 7; thence along Lot No. 6 South 49 degrees 24 minutes 21 seconds West, a distance of 89.26 feet to an iron pin; thence continuing along Lot No. 6, South 26 degrees 48 minutes 14 seconds West, a distance of 45.52 feet to an iroo pin; theoce continuing along Lot No. 6 South 54 degrees 51 mioutes 38 seconds East, a distance of 304.28 feet to an iroo pin; thence continuing along Lot No. 6 and through Shed Road (T-412) South 82 degrees 20 minutes 08 seconds East, a distance of 753.09 feet to a point on the Center Line of Shed Road, said point being the place of BEGINNING. CONTAINING 727,563.8 square feet or 16.7026 acres gross area, with a net acreage of 16.6109 acres to the Dedicated right of way line. BEING known as Lot No. 7 as shown on a plan of lots prepared by Realm~d, Inc. by Hoover Engineering Services, Inc., dated March 30, 2000 and recorded July 25, 2000 in the Office of the Recorder of Deeds of Cumberland County io Plan Book 81, Page 93.
