STIPULATION AGAINST LIENS
THIS AGREEMENT made the 25th day of April, 2001, by and
between W. LEE ROLAND, Builder, of 101 Windrush Lane,
Mechanic~bur~, PA 17055, hereinafter referred to as Contractor,
AND W. LEE ROLAND and ROSALIE H. ROLAND, husband and wife, of 337
West Meadow Drive, Mechanicsburg, PA 17055, hereinafter referred
to as Owner, whereby the former undertook and agreed to erect and
construct a single-family residential dwelling on that certain
lot of ground situate on Vicksburg Court in Silver Spring
Township, Cul~berland County, Pennsylvania, being Lot No. 27,
Final Subdivision Plan for Hillside Farms - Phase II, dated
September 17, 1998, last revised June 23, 2000, said plan being
recorded in Plan Book 81, Page 67. Being a part of the same
premises which Martha D. Hempt, widow, by Deed dated November 10,
1999 and recorded November 17, 1999 in the Cumberland Recorder of
Deeds Office in Deed Book 211, Page 710, granted and conveyed
unto Hempt Realty, LTD. Also being the same premises which Hempt
Realty, LTD. by Deed dated April ~d , 2001 and recorded in the
Cumberland County Recorder of Deeds Office in Deed Book ,
Page , granted and conveyed unto W. Lee Roland and Rosalie H.
Roland, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
