DANDY, DECEASED KNOW ALL MEN BY THESE PRESENTS, that WHEREAS, Daniel A. Dandy, late ofd Carlisle, Cumberland County, Pennsylvania, deceased, died testate on October 5, 20C19, having first made his Last Will and Testament, which was executed on December 19, 2005 and is duly recorded in Cumberland County Courthouse, Register of Wills, File No. 21-09-1020. WHEREAS, Daniel A. Dandy, by the aforesaid Last Will and Testament, named Daniel J. Dandy as Executor of his Last Will and "testament; WHEREAS, Letters Testamentary on the estate of the decedent were duly issued by the Register of Wills of Cumberland County, Estate No. 2109-1020, and Letters were granted to Executor, Daniel J. Dandy, hereinafter called Personal Representative; WHEREAS, the Personal Representative has gathered the assets of the estate of the decedent, and the assets consist of real and personal property with a total value of $49,377.95 as set forth in Exhibit A, which is a statement of account of the said Personal Representative, and which is attached hereto and made a part hereof and marked Exhibit A; WHEREAS, Daniel J. Dandy was appointed Trustee of the Special Supplemental Care Trust for the Benefit of Daniel A. Dandy (Trust), dated March 12, 2006; WHEREAS, upon the death of Daniel A. Dandy, the remaining balance oi:~ the Trust was to be distributable in accordance with the Trust agreement, which stated that upon the death of Daniel A. Dandy, the Trust shall terminate, and all remaining trust assets and accumulated income shall be distributed outright in equal shares to Daniel J. Dandy and Gina Dandy, per stirpes. WHEREAS, Daniel J. Dandy and Gina Dandy survived Daniel A. Dandy; WHEREAS, the of balance of the Trust principal and income was distributed. to Daniel J. Dandy and Gina Dandy in accordance with the terms of the Trust agreement and without the formality of filing an accounting in any court having jurisdiction; WHEREAS, the balance for distribution as shown in the statement marked Exhibit A has been distributed as herein indicated in accordance with the terms of the Last Will and 'Testament of the decedent; NOW, THEREFORE, KNOW YE, that we, Daniel J. Dandy and Gina Dandy, being the beneficiaries and heirs of the decedent, and being those persons entitled to inherit under the Last Will and Testament, do hereby acknowledge that we have this day had and received from the Personal Representative, in full satisfaction and payment, all sum or sums of money, legacies, bequests and devices as are given, devised and bequeathed to us, which amounts we have received this day, and which amounts are set opposite our names in the table and schedule of distribution in the statement attached hereto and marked Exhibit A; AND, we do hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we agree that no account is necessary; and we do hereby consent to distribution being made without the filing of an account and schedule of distribution, the same to be with the same force and effect as if it had been filed and confirmed by the Orphans' Court Division of the Court of Common Pleas, Cumberland County. THEREFORE, we and each of us do hereby remise, release, quit claim and forever discharge the Personal Representative, Daniel J. Dandy, his heirs, executors, administrators and assigns, of and from the estate and from all actions, suits, payment, accounts, reckoning, claims and demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever touching upon the estate of the decedent; and each of us do further hereby covenant and agree that should any liability come due to the estate of the decedent after the signing of this agreement, each of us do hereby covenant and agree with each other and the Personal Representative that we will contribute pro rata our share of the estate to satisfy any and all claims, demands, suits or causes of action which may be successfully prosecuted against the estate or the Personal Representative after the signing, sealing and delivery of this Family Settlement Agreement and Final Release.
