Plaintiff, ENT Federal Credit Union, is a financial institution organized and existing under the laws of the State of Colorado, having an address of P.O. Box 15819, Colorado Springs, Colorado 80935. 2. Defendant, Sean A. Gladfelter, is an individual and citizen of the Commonwealth of Pennsylvania, residing at 209 Herman Avenue, Apt. 1, Lemoyne, Pennsylvania 17043. 3. At the special insistence and request of the Defendant, the Defendant executed a Retail Installment Sale Contract, pursuant to which the Defendant was provided with financing in the amount of $12,567.60 by the Plaintiff. A true and correct copy of said Retail Installment Sale Contract is attached hereto, made a part hereof and marked as Exhibit "A". 4. The Plaintiff provided the Defendant with financing for a 2001 Oldsmobile Aurora. The Defendant was charged a price which was the fair and reasonable price for said vehicle and a price the Defendant agreed to pay. 5. The Defendant defaulted upon the terms of the Retail Installment Sale Contract. 6. Plaintiff repossessed said motor vehicle and sold it at a public auction. The Plaintiff received $384.00 for said vehicle, leaving an outstanding principal balance plus interest of $8,995.92. 7. In addition, pursuant to the terms of the Retail Installment Sale Contract attached hereto as Exhibit "A", the Defendant agreed to pay all attorney's fees and other costs necessary for the collection of any amount not paid when due. 8. Plaintiff has incurred expenses, including legal fees, as a result of having instituted this action and will be obliged to incur similar obligations in the future. 9. Defendant has breached his contract with Plaintiff by not paying said balance due. WHEREFORE, Plaintiff demands judgment against the Defendants in the amount of $8,995.92, together with attorney's fees in the amount of $2,248.98, interest from the date of judgment and anticipated court costs of $192.00.
