DiMarcello, is an adult individual residing at 310 Folkstone Way, York, York County, PA 17402. 2. Defendant, India Wright, is an adult individual residing at 809 West Poplar Street, York, York County, PA 17404. 3. On or about December 6, 2003, Plaintiff owned a 2000 Mitsubishi Galant with Pennsylvania registration plates DJB3904. 4. On or about December 6, 2003, Defendant owned a 1995 Hyundai Accent with Pennsylvania registration plates FJA4644. 5. On the aforesaid date, Plaintiff was operating the Mitsubishi Galant on Bridlewood Way. 6. On the atoresaid date, Defendant lost control of her vehicle and exited a private roadway directly in front of Plaintiffs vehicle, causing a collision between the two vehicles. 7. The collision caused damage to Plaintiffs vehicle in the amount 01'$1,259.58. A true and correct copy ofthe estimate is attached hereto as Exhibit "A." 8. The aforementioned collision was caused as the result of the negligence, recklessness, and carelessness of Defendant in that he: a. operated a vehicle in a careless, reckless, and negligent manner; b. failed to properly operate and control the vehicle; c. operated the vehicle in careless disregard for the safety of Plaintiff s property (75 Pa. C.S.A S3714); d. failed to keep a proper look out; e. failed to use due care under the circumstances; and f. operated the vehicle in disregard of the Rules ofthe Road, the ordinances of the local municipality and the laws ofthe Commonwealth of Pennsylvania. 9. At all times material hereto, Plaintiff acted with due care and was not contributorily negligent. 10. Defendant was the direct and proximate cause of the collision. I I. Plaintiff has demanded compensation for the loss they sustained and Defendant has failed to pay. WHEREFORE, Plaintiff demands judgment against Defendant in the amount of$1 ,259.58, exclusive of interest and costs; an amount within compulsory arbitration limits.
