STIPULATION
IT IS HEREBY AGREED AND STIPULATED by and between the Pennsylvania
State Police and Chades EMERY as follows:
1. The above-referenced 1967 Dodge Coronet, beadng the fraudulent Vehicle
Identification Number, WS23L71133849, which was seized as a result of an
investigation, Incident No. X42-0024740 and is currently being held by the
Pennsylvania State Police.
2. Charles EMERY is the dghtful owner of the 1967 Dodge Coronet.
3. The Pennsylvania State Police, upon receipt of a Court Order, shall voluntarily
release the 1967 Dodge Coronet to the custody of Chades EMERY.
4. Charles EMERY shall remove the above referenced 1967 Dodge Coronet from
Pennsylvania State Police Impound yard in Harrisburg, PA.
5. Charles EMERY agrees to promptly pay all charges incurred in the repossession,
retrieval, towing and storage of the vehicle.

PETITION FOR THE RETURN OF PROPERTY HELD BY THE COMMONWEALTH
PURSUANT TO 75 PA. C.S.A. ~ 7105
AND NOW, comes the Petitioner, Chades EMERY, respectfully requests that this
Court issue an Order releasing the above-referenced 1967 Dodge Coronet, based on
the following:
1. A 1967 Dodge Coronet was seized during an investigation conducted by
the Pennsylvania State Police. The vehicle was seized based on the fact
that the true Vehicle Identification Number for the vehicle could not be
determined. The vehicle was bearing fraudulent VIN #WS23L71133849.
2.The aforesaid 1967 Dodge Coronet was titled in the state of New York.
3. A copy of the Certificate of Title or documentation verifying ownership is
attached hereto and marked as Exhibit "A'.
4. The above mentioned 1967 Dodge Coronet, is currently in the custody of
the Pennsylvania State Police in the Impound Yard at Harrisburg, PA.
5.Charles EMERY is the rightful owner of the 1967 Dodge Coronet.
6. The Pennsylvania State Police have stipulated to Charles EMERY,
ownership of the above referenced 1967 Dodge Coronet. A copy of said
Stipulation is attached hereto and marked Exhibit "B".
7. Pursuant to 75 Pa. C.S. § 7105, Chades EMERY is entitled to possession
of the 1967 Dodge Coronet.
8. Pursuant to 75 Pa. C.S. § 7105, Charles EMERY must obtain a State
replacement vehicle identification number plate through the Pennsylvania
Department of Transportation (PennDO'l').

WHEREFORE, Charles EMERY respectfully requests that this Honorable Court
issue an Order directing the Pennsylvania State Police to forthwith release the 1967
Dodge Coronet to the custody of Chades EMERY. Also that the Pennsylvania
Department of Transportation issue Charles EMERY a State replacement vehicle
identification number plate.

AND NOW, this ~, 2004, upon consideration of the Petition of Charles
EMERY, and the stipulation by and between the Pennsylvania State Police, Tpr.
Trent HURLEY, it is hereby Ordered that the Pennsylvania State Police shall
release the 1967 Dodge Coronet originally bearing fraudulent Vehicle
Identification Number, WS23L71133849, to the custody of Charles EMERY. It is
also ordered that Charles EMERY obtain a State replacement Vehicle
Identification Number plate for the 1967 Dodge Coronet through the
PennsyLvania Department of Transportation.
