KEELEY, INC., Contractor In the Court of Common Pleas Cumberland County, Pennsylvania Number Term WHEREAS, Owner, with their principal address of 1032 Dogwood Lane, Enola, Cumberland County, Pennsylvania, is about to execute contemporaneously herewith, a contract, with WILLIAM D. KEELEY, INC., Contractor, of 512 Partridge Court, Mechanicsburg, Pennsylvania, for the construction and/or erection of improvements for Lot 45 of Village of Westover, 204 Downing Place, in Hampden Township, Cumberland County, Pennsylvania, more fully described on Exhibit A attached hereto and made a part hereof. NOW, this 2'- dayof ~bt~ t4,S ~ ,2004, at the time of the execution of the principal contract, and before any~'authority has been given by the said Owner to the said Contractor to commence work on the said building or to purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of one dollar, to Contractor paid by Owner it is agreed that no lien shall be filed against the building by the contractor, or any subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. This Stipulation against Liens may be executed in counterparts, each of which shall be fully effective as an original and all of which together shall constitute one and the same instrument. I/J pBYri:nt Name: ~¢t./~ ~/~ EXHIBIT A ALL THAT CERTAIN tract or parcel of land situate in the Township of Hampden, County of Cumberland and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit: BEGINNING at a point on the northern side of Downing Place at the dividing line between Lots Nos. 44 and 45 as shown on the hereinafter mentioned plan of lots; thence continuing along line of said Lot No. 45, North 50 degrees 09 minutes 05 seconds East, a distance of 169.58 feet to a point, said point being the intersection of Lot 45 and the western side of Area of Penn Dot Take; thence along Area of Penn Dot Take, South a distance of 241.36 feet to a point, said point being the intersecting point of Lots Nos. 45 and 46; thence along dividing line between Lots Nos. 45 and 46 and Area of Penn Dot Take, North 71 degrees 05 minutes 56 seconds West, a distance of 181.97 feet to a point on the northern side of Downing Place; thence continuing along Downing Place by a curve to the right having a delta of 58 degrees 44 minutes 59 seconds, a radius of 70.00 feet, a tangent of 39.40 feet, and an arc distance of 7138 feet to a point the place of BEGINNING. BEING KNOWN AND NUMBERED AS 204 Downing Place, Mechanicsburg, PA 17050. UNDER AND SUBJECT, nonetheless to the restrictions and covenants set forth in the aforedescdbed Final Development Plan and further by those restrictions, reservations and covenants as set forth in Miscellaneous Book 356, Page 3 through 8, as though, they were more fully set forth herein and are herein made applicable to and shall run with the land herein conveyed.
