STIPULATION WAIVER OF RIGHT TO FILE LIEN
WHEREAS, E.K. Services Inc. (hereinafter "CONTRACTOR"), having an
office at 260 Old York Road, New Cumberland, PA 17070 has entered into a In
contract dated April 13, 2011 with Pennsylvania-American Water Company (hereim r M_

"OWNER"), having an office at 800 West Hersheypark Drive, Hershey, PA 17033,c

t materials and equipment and to perform labor necessary for the construction of the lct C ,

entitled "Shiremanstown Water Main Replacement" situated in Shiremanstown Bor u j , 0
Cumberland County, Pennsylvania, and located along Main Street.
NOW, THEREFORE it is hereby stipulated and agreed by and between the said parties, as
' part of the said contract and for the consideration therein set forth, that neither the undersigned
' CONTRACTOR, any subcontractor or material-man, nor any other person furnishing labor or
materials to the said CONTRACTOR under this contract shall file a lien, commonly called a
mechanic's lien, for work done or materials and equipment furnished to the said Project or any part
thereof.
This stipulation is made and intended to be filed with the Cumberland County Prothonotary
within ten days after the date hereof, in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
