COMPLAINT Attorneys for Plaintiff CIVIL TERM CIVIL ACTION - LAW AND NOW, comes the Plaintiff, Scott W. Harvey, by and through his attorneys, Johnson, Duffie, Stewart & Weidner, P.C., who files this Complaint by respectfully stating the following: 1. Plaintiff, Scott W. Harvey ("Harvey") is an adult individual who resides at 6345 Powderhorn Road, Mechanicsburg, Cumberland County, Pennsylvania. 2. Defendant Eric Fogelsanger ("Fogelsanger") is an adult individual and sole proprietor of a business entity known as (and with a registered fictitious name owned by Fogelsanger) Cedar Ridge Construction and is believed to reside at 481 West 8'/ Street, Bloomsburg, Columbia County, Pennsylvania 17815. 3. In or about July 2010, Fogelsanger approached Harvey with a request for a business loan in the amount of Twenty Thousand Dollars ($20,000.00) in principal. AVISO USTED HA SIDO DEMANDADO/A EN CORTE. The business loan was to be used to rehabilitate a property located at 7 Palmyra Belllegrove Road, Annville, Lebanon County, Pennsylvania 17033 so that it could be sold. 5. The parties agreed to the business loan on the terms that Fogelsanger would repay the $20,000.00 principal amount of the loan on or before October 15, 2010, plus make a payment at that time of $5,000.00 in interest. The $25,000.00 payment on the loan was to be made to Harvey at his residence in Cumberland County. 6. Under those terms, Harvey delivered a check to Fogelsanger, made payable to his proprietorship, Cedar Ridge Construction, in the amount of $20,000.00. A true and correct copy of the loan check is attached hereto as Exhibit A with redactions made to protect privacy. 7. The aforementioned loan check was delivered by Harvey to Fogelsanger on July 13, 2010, and the memorandum line clearly states "Loan to be Paid 10/15." See, Exhibit A. 8. On or about October 15, 2010, Fogelsanger delivered a check to Harvey in the amount of $25,000.00 with the memorandum line on the check reading "Loan;" however, said repayment check was returned for non-sufficient funds. A true and correct copy of the repayment check dated October 15, 2010, and the notation from Metro Bank indicating that the check was returned NSF is attached hereto as Exhibit B with redactions made to protect privacy. 2 9. Since the repayment check was returned to Harvey as NSF, Harvey has made numerous requests for payment in full of the outstanding loan balance of $25,000.00. 10. Although Fogelsanger has admitted to the amount due and owing, he has refused to make payment of the same to Harvey. 11. As such, Harvey seeks redress from the Court to receive repayment of the loan as a last resort. 12. Jurisdiction and venue is appropriate in the Court of Common Pleas of Cumberland County since Fogelsanger agreed to make repayment of the loan to Harvey's residence in Cumberland County. COUNT I - BREACH OF CONTRACT 13. Plaintiff incorporates herein by reference paragraphs 1 through 12 as if the same were more fully set forth herein. 14. The parties entered into a verbal loan agreement which was confirmed by the checks given by each related to said loan. See, Exhibits A and B. 15. Under the loan terms, Fogelsanger was required to repay the $20,000.00 in principal plus $5,000.00 in interest to Harvey on or before October 15, 2010. 16. Harvey has made numerous requests for payment, which have been denied. 3 17. Harvey is entitled to interest at a rate no less than 6% per annum from October 15, 2010 until the date when the loan is repaid in full by Fogelsanger and a demand is made therefore. WHEREFORE, the Plaintiff, Scott W. Harvey, demands judgment against the Defendant, Eric Fogelsanger d/b/a Cedar Ridge Construction, in the amount of $25,000.00 plus interest at an amount of 6% per annum plus any such other relief this Honorable Court deems appropriate. COUNT II - UNJUST ENRICHMENT 18. Plaintiff incorporates herein by reference paragraphs 1 through 17 as if the same were more fully set forth herein. 23. Fogelsanger received $20,000.00 from Harvey in the form of a loan on or about July 13, 2011. See, Exhibit A. 24. It is believed and averred that Fogelsanger used the loan proceeds for his own personal benefit. 25. Fogelsanger's failure to make full payment to Harvey has unjustly enriched Fogelsanger in a minimum amount of $20,000.00 plus interest since July 13, 2010. 4 WHEREFORE, the Plaintiff, Scott W. Harvey, demands judgment against the Defendant, Eric Fogelsanger d/b/a Cedar Ridge Construction in the amount of $20,000.00 plus such other relief this Honorable Court deems appropriate.
