("Contractor") in favor of Pyrotek, Inc. ("Owner"). Whereas, Owner is about to execute contemporaneously herewith, a contract with Contractor for the construction of a building addition and related site work upon a lot of land situate in Middlesex Township, Cumberland County, Pennsylvania, being known as Lot No. 32-A on the Final Subdivision Plan of Route 8 i-Turnpike Associates, more fully described as follows: Beginning at a concrete monument on the northern dedicated right-of-way line of Claremont Road (S.R. 2002) said monument being located a distance of 281.98 feet from the terminus of a curve connecting the western right-of-way line of S. Middlesex Road (S.R. 1005) to the northern dedicated right-of-way line of Claremont Road (S.R. 2002), measured along said right-of-way line; thence along the northern dedicated right-of-way line of Claremont Road (S.R. 2002) South eighty six degrees, twenty minutes, thirty four seconds West (S. 86° 20' 34" W.) a distance of two hundred sixty five feet (265.00') to a point; thence along the eastern line of Lot 31 North zero degrees, fifty two minutes, two seconds East (N. 00o 52' 02" E.) a distance of four hundred twenty eight and twelve hundredths feet (428.12*) to a point on the line of lands now or late of Middlesex Warehouse Investors, L.P.; thence along said lands North fifty nine degrees, one minute, forty two seconds East (N. 59o 01' 42" E.) a distance of three hundred ninety four and fifty four hundredths feet (394. to a point; thence continuing along the same South forty six degrees, thirty nine minutes, fifty five seconds East (S. 460 39' 55" E.) a distance of two hundred seven and seventy four hundredths fi~et (207.74~ to a point at the northern corner of Lot 32; thence along the northwestern line of Lot 32 South fifty nine degrees, one minute, forty two seconds West (S. 59o 01' 42" W.) a distance of two hundred ninety three and seventy eight hundredths feet (293.78') to a point; thence along the same South three degrees, thirty nine minutes, twenty six seconds East (S. 03o 39' 26" E.) a distance of three hundred twenty one and eleven hundredths feet (321.11~) to a point, said point being the place of Beginning. Now, May 3, 2001, at thc time of and immediately before thc execution of the construction contract aforesaid, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materbJs for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any of the materlalmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
