THIS AGREEMENT, made the ~'~[X'day of May, 2001, by and between
GALBRAITH PRE-DESIGN, INC., of 213 Kutz Road, Carlisle, Pennsylvania 17013
(hereinafter referenced as "Contractor")
AND
FLENNIKEN of 121 Stonehedge Drive, Carlisle, Pennsylvania 17013
r referenced as "Owner"), whereby the former has undertaken and agreed to
erect and construct a cormnereial office building on that certain lot of ground situate in
South Middleton Township, Cumberland County, pennsylvania, being known as Lot 20
on the Land Subdivision Plan of Cantral State Plaza dated June 3, 1955, and recorded in
Cumberland County Plan Book 56. Page 12lA and more particularly bounded and
described in Cumberland County Deed Book 241, Page 231.
NOW, THEREFORE, THIS AGREEMENT W1TNESSETH: That the said
Contractor, for and in consideration of the sum of One and No/100 ($1.00) Dollar to it in
hand paid by Owner, the receipt whereof is hereby acknowledged, and the further
for itself and its subcontractors, and
consideration mentioned in the agreement aforesaid. · ' ' s
all parties acting through or under them, covenant and agree that no mechanic s lien or
claims shall be filed or maintained by them or any of them against the said building and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in or
about the erection and construction of the said buildings on the lot above-described, and
the said Contractor, for itself, its subcontractors and others under them hereby expressly
waive and relinquish the right to have, file and maintain any mechanic's liens or claims
against the said building, and agree that this instrument, waiving the right of lien, shall be
an independent covenant.
