HomeMy WebLinkAbout01-2938 STIPULATION A~AINST LI~NS T~IS AGREEMENT made the llth of May, 2001, by and between WILLIAM WIRL, Builder, GREGORY D. STUMP and KATHY C. STUMP, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Lot #3 Peffer Road Mechanicsburg PA, as per attached legal NOW '~'~REFORE, THIS AGREEMENT WITNEESETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to William Wirl in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Nicholson, prepared by Eric L. Diffenbaugh, P.L.S., dated October 24, 1997 (Revised February 12, 1998), recorded July 2, 1998 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 77, Page 21, and being more fully described as follows to wit: BEGINNING at a point along lands of Paul Peffer, said point being the common property corner of Lot #2 and Lot #3 of the Final Subdivision Plan for Duane E. Nicholson; thence along lands of Paul Peffer South 18 degrees 24 minutes 48 seconds East 291.52 feet to an existing corner post; thence along lands of Ralph Deitch South 71 degrees 17 minutes 26 seconds West 483.72 feet to an existing corner post; thence along lands of the Township of Monroe North 16 degrees 38 minutes 17 seconds West 309.00 feet to a set iron pin; thence along Lot #1 North 73 degrees 21 minutes 43 seconds East 217.57 feet to a set iron pin; thence continuing along Lot #1 * North 16 degrees 36 minutes 17 seconds East 430.55 feet to a set Parker-Kalon Nail in Peffer Road, said Parker-Kalon Nail being North 16 degrees 38 minutes 17 seconds West 30.16 feet from a set iron pin; thence through Peffer Road North 85 degrees 22 minutes 31 seconds East 51.12 feet to a set Parker-Kalon Nail, said Parker-Kalon Nail being North 16 degrees 38 minutes 17 seconds West 29.41 feet from a set iron pin; thence along Lot #2 South 16 degrees 38 minutes 17 seconds East 419.91 feet to a set iron pin; thence continuing along Lot #1 North 73 degrees 21 minutes 43 seconds East 216.98 feet to a set iron pin the point of BEGINNING. BEING Lot #3 containing 3.8250 acres as set forth on Final Subdivision Plan for Duane A. Nicholson. BEING THE SAME PREMISES which Duane A. Nicholson and Jean Ann Nicholson, husband and wife by deed dated March 10, 2000, recorded March 15, 2000 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed Book 217, Page 652, granted and conveyed unto Gregory D.
