WHEREAS, Wheatland Custom Homes, Inc., of 447 Granite Run Drive,
Lancaster, Pennsylvania, is abm j! m execute contemporaneously herewith, a contract with
Wheatland Custom Homes, Inc. of Lancaster County, Pennsylvania, for the erection of a
dwelling upon a Im of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township,
Cumberland County, Commonwealth of Pennsylvania, more panicu)arly bounded and
described to wit*'
BEGINNING at a point on the s,~ulhern right-of-way line of Sommerton
Drive at lhe common front property comer of Lot No. 320 and Lot No. 321 as shown on
the hereinafter mentioned plan of lots; thence along said right-of-way line North 40 degrees

a radius of 475.00 feez and an arc length of 20.00 m a point; thence South 49 de~rees 42

Lol No. 21 and land now or formerly of Creekview Subdivision; thence along said dividing

the dividing line between Lot No. 320 and Lot No. 321; thence along said dividing line

point being the Place of BEGINNING.
THE ABOVE-DESCRIBED TRACT BEING KNOWN AS Lot No. 321 of the
Final Subdivision Plan of Hampden Hearth. Phase IV-B recorded in the Cumberland
County Courthouse in Plan Book 79, PaRe 107, The above described tract containing
10,181.14 square feet, more or less.

THE ABOVE DESCRIBED-TEAC! BEING SUBJECT TO various easements
of record as indicated on the above-referenced Subdivision Plan.
UNDER AND SUBJECT to Declarations recorded in Miscellaneous Book
340, Pa~e 491, and Miscellaneous Book 433, PaRe 942, in Cumberland County,
Pennsylvania.
NOW, the /(*~ay of May, 2001, at the time of and immediately
before the execution of the principal contrarL and before any authority has been given by
the said Wheatland Custom Homes, Inc., t,~ the said Wheatland Custom Homes, Inc. to
commence work on the said building, c~ purchase materials for the same in consideration
of the making of the said contract with Wheatland Custom Homes, Inc. and the further
consideration of One Dollar, to Wheatland Custom Homes. Inc. paid by Wheatland
Custom Homes, Inc., il is agreed that no lien shall be filed against ihe building by the
contractor, or any subcontractor, nor by any of the material men or workmen or any other
parson for any labor, or materials purchased, or extra labor or materials purchased for the
erection o! said building, the right to file such liens being expressly waived.
