No. 04-371 Civil Term DONALD DONAGHER Defendant COM P L A I N T 1. plaintiff is EMPIRE TV & APPLIANCES, INC., t/d/b/a Barstools & Billiards, a registered fictitious name operated by a Pennsylvania Corporation, with its principal place of business located at 221 N. Prince St., Lancaster, PA 17603. 2. Defendant is DONALD DONAGHER, an adult individual residing at 3 penns Way Road, Mechanicsburg, PA 17052. 3. At all times relative to this action Plaintiff operated a retail location at 4700 Carlisle Pike, Mechanicsburg, PA 17055. At said retail location, Plaintiff sold various recreation room items including bars, pool tables, and billiard tables. 4. On or about January 2, 2004, Defendant entered Plaintiff's retail location and purchased a 74" K-bar with accessories. The purchase price for said bar was $2,001.28. Defendant paid to Plaintiff that full amount using his American Express card. 5. A few months later, Defendant returned to Plaintiff's retail location and purchased a 90" marquis bar for a total purchase price, including tax and delivery charges, of $7,155.00. He transferred the deposit on the 74" K-bar to the new 90" marquis bar at that time. Copies of the Sales Orders are attached hereto and made a part hereof as Exhibit "A". 6. As a result of the purchase of the 90" marquis bar, Defendant owed to plaintiff the balance for the marquis bar of $5,153.75. 7. The marquis bar was delivered to Defendant's premises and set up by Plaintiff's delivery people in accordance with the instructions of Defendant. 8. The balance due and owing to Plaintiff was not paid by Defendant at the time of delivery. As per the parties agreement, the balance was due and owing at delivery. 9. Following delivery of the marquis bar, plaintiff left several messages for Defendant requesting the balance due and owing on the account. 10. Despite repeated demand, Defendant has failed and refused to pay to Plaintiff the balance of $5,153.75 for the marquis bar. 11. Plaintiff filed an action before District Justice Thomas A. Placey and was awarded j ud3ment against Defendant and incurred costs in the amount of $133.50 to pursue this matter against Defendant. 12. Despite repeated demands, Defendant has failed and refused to pay the total amount due and owing to plaintiff of $5,153.75 plus the court costs incurred by Plaintiff in the amount of $133.50 for a total amount due and owing of $5,287.25. Defendant acknowledges that he owes a balance to Plaintiff, but the amount of the claim is in dispute. 7. Admitted. 8. Defendant admits that there is a balance due.
