AND NOW, this 31st day of May, 2011, upon
consideration of the Petition for Determination of Proper Agent
under Power of Attorney, and following an initial period of
hearing, which has not yet been completed, the record shall
remain open, and counsel are requested to contact the Court's
secretary for purposes of scheduling a further day of hearing.
It is noted that at the time of adjournment on
today's date Petitioner was presenting the testimony of herself
on direct examination. No other witnesses had been called by the
Petitioner or Respondent. It is further noted that Petitioner's
Exhibits (which have been denominated Plaintiff's Exhibits) 1, 2,
3, 4, 5, 6, 7, 8, 9, 10, and 11 had been identified and admitted
without objection. Plaintiff's Exhibit 12 (attorneys fees) had
been referred to, but not fully identified or admitted.
Defendant's counsel had requested a copy of the
notes of testimony from today's proceeding, Plaintiff's counsel
did not.
