IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION - LAW KLINE TRANSPORT SERVICES, LLC NO.2011- DEFENDANT COMPLAINT BREACH OF CONTRACT CIVIL TERM AND NOW, this 6th day of June 2011, comes the Plaintiff, CUMBERLAND TRUCK EQUIPMENT COMPANY, by and through his attorneys, Irwin & McKnight, P.C., and makes the following Complaint against the Defendant, KLINE TRANSPORT SERVICES, LLC', as follows: 1. The Plaintiff is Cumberland Truck Equipment Company, a Pennsylvania Corporation with an office located at 25 Roadway Drive, Carlisle, Cumberland County, Pennsylvania 17015. 2. The Defendant is Kline Transport Services, LLC, a Pennsylvania Corporation with an office located at 330 Woodcrest Drive, Lancaster, Lancaster County, Pennsylvania 17602. 3. The Defendant has an account with the Plaintiff which was used to purchase equipment and services from the Plaintiff. 3 COUNTI CUMBERLAND TRUCK EQUIPMENT COMPANY V. KLINE TRANSPORT SERVICES, LLC 4. Paragraph One (1) through Three (3) of this Complaint are incorporated by reference and made a part of this Count. 5. The Defendant, Kline Transport Services, LLC, has purchased equipment and services from the Plaintiff and now owes to the Plaintiff an account balance in the amount of $14,898.59. A copy of current balance is attached hereto and marked as Exhibit "A" and made a part of this Complaint. 8. Despite repeated requests by the Plaintiff for payment, the Defendant has refused to pay the account balance thereby breaching its contract agreement with the Plaintiff. 9. The Plaintiff is entitled to interest on the account balance, the costs of this action, and reasonable legal fees required to bring this action. WHEREFORE, the Plaintiff, Cumberland Truck Equipment Company, requests that judgment be entered against the Defendant, Kline Transport Services, LLC, for the sum of $14,898.59 with legal fees, costs and interest as provided by law.
