COMPLAINT
BREACH OF CONTRACT
AND NOW, this 6th day of June 2011, comes the Plaintiff, CUMBERLAND TRUCK
EQUIPMENT COMPANY, by and through his attorneys, Irwin & McKnight, P.C., acid makes the
following Complaint against the Defendant, HENRY L. TAYLOR TRUCKING COMPANY and
MT. VALLEY FARM AND LUMBER, as follows:
1. The Plaintiff is Cumberland Truck Equipment Company, a Pennsylvania Corporation with
an office located at 25 Roadway Drive, Carlisle, Cumberland County, Pennsylvania 17015.
2. The Defendant is Henry L. Taylor Trucking Company, a Pennsylvania Corporation with an
office located at 1280 Nawaka Road, Biglerville, Adams County, Pennsylvania 17307.
3. The Defendant is Mt. Valley Farm and Lumber with an office located at 1240 Nawaka Road,
Biglerville, Adams County, Pennsylvania 17307.
4. Both Defendants have accounts with the Plaintiff which they used to purchase equipment
and services from the Plaintiff.
5. Both Defendants have common ownership of the respective businesses, assets, and
liabilities.

6. Paragraph One (1) through Five (5) of this Complaint are incorporated by reference and
made a part of this Count.
7. The Defendant, Henry L. Taylor Trucking Company has purchased equipment and services
from the Plaintiff and now owes to the Plaintiff an account balance in the amount of $98,724.93. A
copy of current account balance is attached hereto and marked as Exhibit "A" and made a part of
this Complaint.
8. Despite repeated requests by the Plaintiff for payment, the Defendant has refused to pay the
account balance thereby breaching its contract agreement with the Plaintiff.
9. The Plaintiff is entitled to interest on the account balance, the costs of this action, and
reasonable legal fees required to bring this action.
WHEREFORE, the Plaintiff, Cumberland Truck Equipment Company, requests that
judgment be entered against the Defendant, Henry L. Taylor Trucking Company, for the sum of
$98,724.93 with legal fees, costs and interest as provided by law.

CUMBERLAND TRUCK EQUIPMENT COMPANY
V.
MT. VALLEY FARM AND LUMBER
10. Paragraph One (1) through Five (5) of this Complaint are incorporated by reference and
made a part of this Count.
11. The Defendant, Mt. Valley Farm and Lumber has an open account with the Plaintiff,
Cumberland Truck Equipment Company. The open account consists of the purchase of equipment
and services which total the sum of $37,045.80. A copy of current account balance is attached
hereto and marked as Exhibit "B" and made a part of this Complaint.
12. Despite repeated requests by the Plaintiff for payment, the Defendant has refused to pay the
account balance thereby breaching its agreement with the Plaintiff.
13. The Plaintiff is entitled to interest on the account balance, the costs of this action, and
reasonable legal fees required to bring this action.
14. The Plaintiff seeks a judgment against both Defendants for the total of the combined
accounts in the amount of $135,770.73 based upon their common ownership together with interest
on both account balances, and costs and reasonable legal fees required to bring this action.
WHEREFORE, the Plaintiff, Cumberland Truck Equipment Company, requests that
judgment be entered against the Defendants, Henry L. Taylor Trucking Company and Mt. Valley
Farm and Lumber, for the sum of $135,770.73 with legal fees, costs and interest as provided by law.

which has an office at 1240 Nawaka Road, Biglerville.

15. Henry L. Taylor Trucking L.L.C. is a duly organized limited liability company
registered with the Pennsylvania Department of State.
16. Mt. Valley Farms and Lumber Products, Inc. is a duly organized limited liability
company registered with the Pennsylvania Department of State.
17. The two companies are separate and distinct from each other.
18. Plaintiff's attempt to impose a joint judgment is improper and against statute and case
law.
19. Plaintiff has failed to establish a basis upon which attorney's fees may be awarded
under the facts of the claims as stated in the Complaint.
20. Plaintiff has failed to establish a basis upon which it is entitled to service charges.
21. Plaintiff has failed to establish the accuracy of the amounts claimed for equipment
and services provided, if any.
22. Plaintiff's claims may be limited or barred by the statute of limitations.
WHEREFORE, Defendant demands judgment in its favor and against Plaintiff.
