SPRIGGLE, of 915 Cumberland Street, Clearfield ~~h Y ~ ~ ~ Y.4 T~ o , Clearfield County, Pennsylvania, do hereby make my Last Will and Testament, ~~revokeu, n ~Y any and all other Wills and Codicils by me at any time heretofore made. 1. I direct that all my just debts and expenses, including the costs of my last illness, burial, cemetery lot and marker, be paid from my estate as soan after my death as shall be consistent with the orderly settlement of my estate, and these expenses shall be considered expenses of the administration of my estate. 2. I order and direct that my funeral shall be modest in character and in keeping with my station in life, and that I be buried in my family burial plot situated in the Hill Crest Cemetery, located in Clearfield Borough, Clearfield County, Pennsylvania, and that there shall be erected on my burial lot a grave marker, substantial, but plain. 3. I direct that all inheritance, estate, succession, or similar duties or taxes which may be levied against my estate or which shall become payable in respect to any property or interest passing by reason of my death, or under my Will or any Codicil which I may hereafter execute, shall be paid out of the principal of my estate, without diminution of any devises, bequests or legacies. 4. I give, devise and bequeath my estate as follows: a) I give, devise and bequeath to my daughter, LINDA J. BOCH, my residence property, and its contents, situated at 915 Cumberland Street„ Clearfield Borough, Pennsylvania, title to which vested in me and my husband by Deed from Pengard Jos ine K Sprigg e -1- Construction, Inc., dated November 15, 1983, and recorded in the Office of the Recorder of Deeds of Clearfield County on January 14, 1992, in Deed and Record Book 1438, page 07. b) I give, devise and bequeath to my daughter, LINDA J. BOCH, the remaining burial lots situate in the Spriggle Family Burial Plot situated in the Hill Crest Cemetery, Clearfield Borough, Clearfield County, Pennsylvania. c) I give, devise and bequeath my Mutual Fund Account to be divided equally between my grandchildren, KELLI BOCH, THOMAS BOCH, JR. , DR. JASON BOCH, JILLIAN PROPST, MARK SPRIGGLE and my daughter-in-law, VICKI SPRIGGLE, in equal parts, share and share alike, if living at the time of distribution of my estate or one (1) year from the date of my death whichever event shall first occur. If any one or more of my grandchild(ren) or daughter-in-law above-named shall have predeceased me, or fail to survive me until the distribution of my estate or one (1) year following my date of death whichever event shall first occur, my surviving grandchild(ren) or daughter-in-law, thereby increasing the remaining share of my surviving grandchild(ren) or daughter-in-law as the case may be. d) All the rest, residue and remainder of my estate, real, personal, and mixed, of whatsoever kind and wheresoever situate, I give, devise and bequeath to my daughter, LINDA J. BOCH, if living; and to her issue, per stirpes, if deceased; the issue of such deceased child of mine to represent their ancestor and to take such deceased ancestor's share per stirpes provided that any persons entitled to a share as a beneficiary under this Paragraph 4(d) are surviving at the time of the distribution of my estatf; or one (1) year following the date of my death whichever event shall first occur. J ephin .Spriggle -2- It being understood that no one entitled to share as beneficiary under this Paragraph 4(d) herein shall share under this bequest unless he or she is surviving at the time of the distribution of my estate or one (1) year following the date of my death whichever event shall first occur. The number of persons sharing in my estate under Paragraph 4(d) of this Will, shall therefore be determined at the time of the distribution of my estate or one (1) year following the date of my death and not at the time of my death. 6. I hereby nominate, constitute and appoint my daughter, LINDA J. BOCH, as Executrix of this my Last Will and Testament, and in the event that LINDA J. BOCH does not survive me or should die simultaneously with me or for any other reasc-n should fail to qualify as Executrix, or if qualified thereafter, should for any reason cease to act, then I nominate, constitute and appoint my grandson, DR. JASON BOCH, as Successor Executor, with all of the authority and powers granted to my Executrix. I direct that my Executrix or Successor Executor shall act without bond in any case and this provision shall apply whether or not they are residents of the Commonwealth of Pennsylvania or the state or jurisdiction where this, my Last Will and Testament, shall be submitted for probate. 7. I authorize and empower my Executrix or Successor Executor, as the case may be, to settle any claims in favor of or against my estate on whatever terms in their sole and absolute discretion they shall determine desirable and they shall not be r. equired to obtain approval of the Court or consent of the beneficiaries under the Will. They are also authorized and empowered in their sole and absolute discretion (on whatever terms they desire without obtaining approval of the Court or consent of the beneficiaries,) to distribute in kind, sell, lease, assign or transfer any portion or all of my estate (including any real estate), and to Joseph Spriggle -3- compromise claims and/or to abandon or dispose of any property or portion thereof (whether real, personal or mixed) which is determined by my Executrix or Successor Executor to have little or no value, and to execute any necessary bills of sale, deeds, leases, or other instruments .
