LAND USE APPEAL NOTICE OF APPEAL CUMBERLAND VALLEY SCHOOL DISTRICT, by and through its attorneys of record, Johnson, Duffle, Stewart & Weidner, files an Appeal from the Decision of the Zoning Hearing Board of Silver Spring Township, Cumberland County, Pennsylvania, (the "Appellee"), and in support thereof, states the following: 1. Cumberland Valley School District is a public school district and political subdivision organized and existing under the laws of the Commonwealth of Pennsylvania, with a primary office located at 6746 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania. 2. The premises subject to this land use appeal is commonly referred to as the "Cumberland Valley Education Park" located at 6746 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania 17050 (sometimes referred to as "Real Property"). 1 S ?? Ul??J /L ot6U 36 3. Cumberland Valley School District is the record owner of the Real Property subject to this land use appeal. 4. The Real Property (Tax Parcel No. 38-07-0461-017) consists of 123.25 acres used for school-related purposes. 5. The Real Property subject to this appeal is zoned High Density Residential (R-2) under the zoning ordinance of Silver Spring Township ("Ordinance"). 6. Public Schools and accessory uses are permitted uses in the High Density Residential Zone (R-2) under the Zoning Ordinance. 7. Sub-Section 205.8 of the Zoning Ordinance provides that all permitted uses in the High Density Residential Zone (R-2) must also comply with the applicable General Provisions set forth in Article 3 of the Zoning Ordinance. 8. Section 313, contained in Article 3 (General Conditions) of the Zoning Ordinance, regulates use of outdoor signs, as it pertains to permitted uses in the High Density Residential Zone (R-2). 9. Cumberland Valley School District utilizes the subject Real Property for a variety of school-related purposes having erected thereon Cumberland Valley High School, Eagle View Middle School, Silver Spring Elementary School, District Administrative Office, District Support Facility, Chapman Field, and numerous athletic facilities and venues, parking lots, and related facilities. 10. On March 15, 2011, Cumberland Valley School District submitted to Silver Spring Township a "Sign Application for Permit" (herein "Sign Permit Application"), 2 seeking approval for the installation of eighteen (18) outdoor signs at various locations throughout the Cumberland Valley Education Park. 11. The proposed signs serve multiple purposes including, but not limited to, replacing existing score boards and the main entrance marquis, in some cases, as well as to provide space to recognize individual and corporate sponsors which have made financial contributions in support of Cumberland Valley School District operations. 12. The signs proposed by Cumberland Valley School District in the Sign Permit Application are as follows: A. Sign No. 1: Chapman Field Replacement Scoreboard Dimension: 36 feet by 10 feet illuminated Number of Sides: 1 Area: 720 square feet (Variance V2011-2) B. Sign No. 2: Chapman Field Concession Stands (2 signs) Dimensions: 16 feet by 2 feet, 8 inches non-illuminated Number of Sides: 1 Area: 42.56 square feet each (Variance V2011-3) C. Sign No. 3: Chapman Field Grandstand Fence (2 signs) Dimensions: 4 feet by 2 feet, 8 inches non-illuminated Number of Sides: 1 Area: 10.64 square feet (Variance V2011-4) D. Sign No. 4: Chapman Field Press Box (4 signs) Dimensions: 4 feet by 2 feet, 8 inches non-illuminated Number of Sides: 1 Area: 10.64 square feet (Variance V2011-5) E. Sign No. 5: Baseball Field Backstop Dimensions: 4 feet by 2 feet, 8 inches non-illuminated Number of Sides: 1 Area: 10.64 square feet (Variance V2011-6) 3 F. Sign No. 12: Soccer Field Replacement Scoreboard Dimensions: 10 feet by 8 feet illuminated Number of Sides: 1 Area: 80 square feet (Variance V2011-13) 4 M. Sign No. 13: Cumberland Valley Education Park Main Entrance Replacement Marquis Dimensions: 16 feet by 7 feet illuminated Number of Sides: 2 Area: 112 square feet (Variance V2011-14) 13. Contemporaneous with filing its Sign Permit Application and at the direction of Daniel Rosario, Zoning Officer for Silver Spring Township, Cumberland Valley School District submitted an Application for Variance ("Variance Application"), seeking a variance from the restrictions for signage size under Section 313 of the Zoning Ordinance. 14. The Zoning Hearing Board for Silver Spring Township held a hearing on April 11, 2011 on the Variance Application submitted by Cumberland Valley School District in support of its Sign Permit Application, after which the Board voted to deny the variance request. By a letter dated May 10, 2011, Daniel Rosario, Zoning Officer for Silver Spring Township, forwarded a copy of the written Decision issued by the Zoning Hearing Board denying the variance request. A copy of the said letter and Decision is attached hereto and incorporated herein by reference. 15. The Zoning Hearing Board, in its written Decision appended hereto, determined that Sub-Section 313.3 of the Zoning Ordinance establishes standards for the maximum number of signs, maximum sign area, and maximum height of free- standing signs and also determined that Sub-Section 313.3 of the Zoning Ordinance would be violated by the placement of the various signs on Cumberland Valley Education Park as set forth above in Paragraph 12. The written Decision issued by the Zoning Hearing Board is legally insufficient in that it fails to specify how the sign package proposed by Cumberland Valley School District would be in violation of Sub- Section 313.3 of the Zoning Ordinance. 5 16. Both the Zoning Officer and the Zoning Hearing Board for Silver Spring Township failed to specify how the sign package proposed by Cumberland Valley School District would be in violation of the Zoning Ordinance, specifically Sub-Section 313.3 thereof. 17. Section 112 of the Silver Spring Township Zoning Ordinance of 2009 defines "Sign" as follows: SIGN - Any identification, description, illustration or devise, illuminated or non-illuminated, which is visible from any public place and which directs attention to a product, service, place, activity, person, institution, business or solicitation, but not flags or other insignia of any government, fraternal or similar organization. 18. Section 112 of the Silver Spring Township Zoning Ordinance of 2009 defines "Permanent Sign" as follows: PERMANENT SIGN - A sign that is expected to be continuously displayed during the presence of a principal land use. 19. The Zoning Hearing Board determined that only two (2) of the proposed signs would be visible from public spaces located off the Cumberland Valley Education Park, those signs being proposed Sign No. 7 proposed to be placed upon the baseball field press box (requested variance V2011-8), which "would be visible to west bound traffic on Carlisle Pike," and Sign No. 13, the proposed replacement marquis for the main entrance of the Cumberland Valley Education Park. See, Written Decision of Zoning Hearing Board, Paragraph 3. 20. With the exception of Sign No. 7 (baseball field press box) and No. 13 (main entrance replacement marquis), the signs proposed by Cumberland Valley School District are not visible from public spaces located outside of the Cumberland Valley Education Park, and consequently said signs have no impact on the health, 6 safety, and general welfare of surrounding businesses and residences, as well as Silver Spring Township at large. 21. With the exception of Sign No. 7 (baseball field press box sign) and No. 13 (main entrance replacement marquis), the signs proposed by Cumberland Valley School District do not fall within the definition of "sign," as set forth in Section 112 of the Silver Spring Township Zoning Ordinance, in that the proposed signs are not "visible from any public place" located outside of Cumberland Valley Education Park, and therefore are not subject to regulation by Silver Spring Township under its Zoning Ordinance or otherwise. 22. Assuming, arguendo, that the proposed signs fall within the definition of "signs," as defined in the Zoning Ordinance, which is specifically denied, the Zoning Hearing Board committed an error of law by denying the variance request, in that Section 313 of the Zoning Ordinance does not limit the number of permanent signs permitted on the subject real estate, but rather allows two (2) permanent signs per principal use for "signs identifying semi-public uses." 23. With the exception of Sign No. 13 (main entrance replacement marquis), the proposed signs are not "signs identifying semi-public uses," as regulated in Section 313, but rather are scoreboard and sponsorship signs which are not prohibited under Section 313 or within the High Density Residential Zone (R-2). 24. The Zoning Ordinance does not limit or restrict the types of signs proposed by Cumberland Valley School District to be placed in various locations throughout Cumberland Valley Education Park, specifically, scoreboards and sponsorship signs, and as such the Zoning Hearing Board committed an error of law when it determined that Cumberland Valley School District was not permitted to erect the signs. 7 25. The Zoning Officer's disallowance of the proposed signs and the Zoning Hearing Board's refusal to grant a variance constitutes an unlawful municipal restriction on Cumberland Valley School District's authority to utilize its facilities and generate non- tax revenue to support school district operations in violation of the Public School Code of 1949, 24 P.S. §1-101, et seq., the Constitution for the Commonwealth of Pennsylvania, and case law decided thereunder. 26. The fact that some of the signs may be used to recognize individual and corporate sponsors who have donated money to support school district operations is inconsequential as to whether the signs are subject to regulation under the Silver Spring Township Zoning Ordinance, to the extent that the signs will not be visible in public spaces outside of Cumberland Valley Educational Park, and therefore will have no impact on the surrounding community. 27. Proposed Sign No. 13 (main entrance replacement marquis) is roughly the same dimensions as the existing main entrance marquis, the primary difference between the existing sign and the proposed sign being that a 16 foot by 4 foot section of the proposed replacement main entrance marquis includes an LED message board. 28. The Zoning Hearing Board committed an error of law when it denied proposed Sign No. 13 (main entrance replacement marquis) in that the proposed replacement sign is roughly the same dimensions as the existing sign, and LED message boards are not prohibited in the zoning district. 29. LED message boards, such as the type proposed by Cumberland Valley School District with respect to Sign No. 13 (replacement main entrance marquis), are ubiquitous along the Carlisle Pike corridor, and the placement of an LED message board at the main entrance of Cumberland Valley Education Park would not adversely impact the health, safety or general welfare of Silver Spring Township. 8 30. As explained above, the Real Property is an expansive 123.25 acres in area and contains various school buildings and facilities which are essential to the operation of the public school district, including but not limited to Cumberland Valley High School, Eagle View Middle School, Silver Spring Elementary School, District Administrative Office, District Support Facility, Chapman Field, numerous related athletic facilities and venues, and parking lots. 31. The vast expansiveness of the Real Property makes it such that Cumberland Valley School District cannot develop and utilize the Property in strict conformance with the provisions of the Silver Spring Township Zoning Ordinance, in that limiting the size and number of signs to be placed on the Property in conformity with the Zoning Ordinance unreasonably restricts the school district's reasonable use of the various facilities located thereon. 32. The Zoning Ordinance, in restricting the number and size of signs to be placed on the Real Property, creates an unnecessary hardship on Cumberland Valley School District in that the Zoning Ordinance restrictions prohibit the school district from reasonably utilizing school and athletic facilities located on the Real Property and from generating non-tax revenue to support school district operations. 33. The Zoning Hearing Board committed an error of law when it denied the variance requests in that: A. There are unique physical conditions of the subject Real Property, to wit its expansive size and the numerous facilities located thereon, creating an unnecessary hardship for the school district; B. Given the physical circumstances or conditions of the Real Property, there is no possibility that Cumberland Valley School District can develop the Real Property in strict conformity with the provisions of the Zoning 9 Ordinance, such that the school district can be afforded the opportunity to reasonably utilize the Property by erecting thereon various signs at facilities located throughout the Real Property which will have limited or no impact on the health, safety, or general welfare of the Township or its residents; C. If permitted, the proposed signs will not alter the essential character of the zoning district or the neighborhood in which the Real Property is located, nor substantially or permanently impair the appropriate use or development of adjacent property, nor be detrimental to the public welfare; and D. The requested variance represents the minimum variance that will afford relief to Cumberland Valley School District and represents the least modification possible of the Silver Spring Township Zoning Ordinance. 34. Cumberland Valley School District believes, and therefore avers, that the action of the Zoning Hearing Board in denying the zoning relief is arbitrary, capricious, and an abuse of discretion, and the Zoning Hearing Board committed errors of law for reasons heretofore stated, as well as the following: A. The Zoning Hearing Board committed an error of law in its interpretation of Section 313 of the Zoning Ordinance; B. The Zoning Hearing Board failed to apply appropriate criteria and standards in its denial of the variance request; and C. Such other reasons as shall be advanced at the time of briefing and argument. WHEREFORE, the Appellant, Cumberland Valley School District, respectfully requests this Honorable Court to grant the appeal herein from the Decision of the Silver 10 Spring Township Zoning Hearing Board for the reasons that it constitutes an abuse of discretion, is arbitrary and capricious and a product of a mistake of law, and to award Cumberland Valley School District appropriate zoning relief, and direct that a sign / zoning permit issue. V 2011-2 thru 2011-14 SCHOOL DISTRICT DECISION DENYING VARIANCES The applicant seeks variances from sign regulations. A hearing on the application was held on April 11, 2011. Although the applicant submitted 13 applications, because they involve similar factual and legal issues, this opinion will address all of the requests. Facts The applicant and owner of the property in question is Cumberland Valley School District of 6746 Carlisle Pike, Mechanicsburg, Pennsylvania 17050. The applicant was represented at the hearing by Joe Medina, Facilities Director, Tracy Panzer, Communications Specialist for the applicant, and James Fry, project architect. 2. The property in question is located on the north side of Carlisle Pike and consists of a multi-acre tract improved as a public school campus. There are three school buildings, an administration building, a district support facility, a stadium, and numerous playing fields. 3. As a revenue generating endeavor, the applicant proposes to erect a number of signs which would include space for advertising by local businesses. The signs would be generally located in connection with athletic facilities. The applicable signs and variance requests are as follows: V2011-2. In connection with the proposed replacement of the Chapman Field scoreboard, the applicant proposes to include a 36 feet by 2.5 feet area for advertising. The overall scoreboard would be 720 square feet. V2011-3. Chapman Field: The applicant proposes two 16 feet by 2 feet 8 inches non-illuminated sign areas below the service counter of the concession stands, one on the Visitor side and one on the Home side. These signs would be strictly for advertising purposes. V2011-4 and 5. Chapman Field Press Box: Six non-illuminated signs would be placed on or adjacent to the press box above the stadium. Each sign would be 4 feet by 2 feet 8 inches and would be oriented toward the inside of the stadium. The signs would be strictly for advertising purposes. V2011-6. Baseball Field: A 24 feet by 2 feet sign would be added to the top of the backstop for advertising purposes. The sign would be oriented toward the interior of the site and would not be visible from Carlisle Pike. V2011-7. Baseball Field Scoreboard: The existing scoreboard would be replaced and advertising space added. The scoreboard area would be 16 feet by 3 feet topped with an illuminated 16 feet by 2 feet area with the school name. Below the scoreboard would be a 16 feet by 2 feet advertising area which would be illuminated. The field itself is not illuminated. V2011-8. Back of Press Box: One 16 feet by 3 feet illuminated sign is proposed for advertising purposes on the back of the press box. The sign would be 40 feet above the ground and would be visible to westbound traffic on Carlisle Pike. V2011-9. Softball Field: A 16 feet 4 inches by 2 feet non-illuminated sign is proposed for the top of the backstop. This sign is for advertising purposes. V2011-10. Softball Field Scoreboard: A new 8 feet by 7 feet illuminated scoreboard is proposed. The bottom 8 feet by 2 feet portion would be for advertising purposes. The middle 8 feet by 3 feet area would serve as a scoreboard and the top 8 feet by 2 feet area would be for the school name. The field itself is unlit. V2011-11. Tennis Courts: A 10 feet by 3.5 feet sign would be erected in an archway between two courts. The top of the sign would be for the school logo and the designated "Tennis Courts" while the bottom 1.5 feet by 3.5 feet area would be for advertising. The sign would be illuminated. V2011-12. Eagle View Stadium: A 24 feet by 5 feet illuminated sign would be erected directly across the playing field from the seating area. This sign would be for advertising purposes only. V2011-13. Soccer Field Scoreboard: A 16 feet by 2 feet non-illuminated area would be added to the existing scoreboard for advertising purposes. V2011-14. Main Entrance: The applicant proposes to replace the existing 16 feet by 17.5 feet illuminated sign with a 16 feet by 7 feet sign which would be divided into two portions. The top would be for the school name while the bottom 16 feet by 4 feet area would be an LED message area. This would be used for school purposes only and would contain no commercial messages. 4. The applicant testified that the purpose of the overall sign program was revenue generation although no detailed information regarding costs and potential revenue return was presented, nor were contracts in place. 5. Appearing at the hearing were several concerned residents. Wayne Stevenson of 49 Texaco Road objected to the amount of commercial advertising proposed in relationship to the commercial advertising allowed to local businesses under the ordinance. Tricia Lacy, an adjoining property owner, expressed concern about the commercialization of an educational institution, and in particular to the negative effects upon the landscape of the Eagle View sign. A representative of the Board of Supervisors expressed opposition by the Board to a number of the signs which were primarily for advertising purposes. 6. Notice of the hearing was posted and advertisement made as required by the ordinance. Conclusions 1. Section 313.3 of the ordinance establishes standards for the maximum number of signs, maximum sign area and maximum height of freestanding signs. This section of the ordinance would be violated by the proposed sign package. 2. Section 604.4 of the ordinance grants the Board the power to grant variances where the provisions of the ordinance inflict unnecessary hardship upon the applicant. 3. The Board finds that the applicant has presented no evidence of hardship unique to the land which would justify the requested variances. There are no irregularities of shape, size or topography which prevent the reasonable use of the property. In fact, it is already extensively developed as an educational campus. The signs in question are not necessary to accomplish that purpose. 4. Granting the variance would alter the essential character of the neighborhood and be contrary to the spirit and intent of the ordinance. The signs are of a commercial nature and contrary to the campus-like nature of the subject property. The total package is in excess of that allowed to commercial businesses and there is no logical reason for allowing business owners to erect commercial signs on a school property in excess of the signs allowed on their commercial properties. Decision In view of the foregoing and having considered the plans and testimony submitted to the Board, it is the opinion of the Board that the variances requested should be and are hereby denied. As I mentioned, Jim Frey is the architect and the professional representing the school district. Tracy Panzer is also with the school district, and she's the communication specialist. Since there is 12 or 13 variance requests, what I'd like to do is just go through your presentation, you know, go through basically one by one your presentation, and then what the Board will do is ask questions per variance, per sign. Just to start off with, we'd like to thank the Board, the Zoning Hearing Board, for listening to our request and the Silver Spring Township representatives who helped us through the whole process. To assist us, we've prepared a campus plan, which you have it in a small -- a reduced version in the submittal and a satellite image that might be easier to try to identify. I mean we brought it for the public who may be here. They may want to adjust and get to a place where they can see it, since it's going to be hard for you to see from Premier Reporting, LLC Linda C. Larson, CSR, RPR, CLR 8 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 But anyway, the purpose for Cumberland Valley School District submitting these applications is to provide local businesses the opportunity to advertise and thus supporting business activity and development in the townships, to benefit Cumberland Valley School District tax payers by raising additional income for the school district in an attempt to mitigate some of the impact of the proposed cuts in Pennsylvania education funding, to replace some existing scoreboards that no longer function. As we go through it specifically, the softball and soccer scoreboards do not function, so we're hoping to replace those. To upgrade existing signs with new technology, such as LED lights. And finally the attached plan that we submitted, it's comprehensive and it's long-term. And based on the advice that we were given, we identified the various things that we made -- we are planning to do. There are some possible unknowns such as the timing of when we would do it, but we wanted to put the whole plan before the Zoning Hearing Board. Again, as introductory remarks, the school district has prepared a request for proposal -- it's in draft form -- that we plan to send out to local businesses to explain what we're planning to do, and we have again a Premier Reporting, LLC 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Linda C. Cumberland Valley acknowledges that many stakeholders have a great deal of pride in the appearance at the school district. And we have every intention to maintain the appearance. These documents that we prepared will help us maintain and control the signs, the content, and so forth, what the appearances are like. Also, just another introductory remark is the school board reviewed an extensive list of various options that we might be looking at. And the ones that we came forward with are ones that we feel that the school board felt did not detract from the overall appearance on the site. With that, I'll refer to the campus plan that we have here. Just to orient, this is Carlisle Pike that runs here. On the satellite image it runs this way, so it's not quite aligned the same way. Chapman Field is here and over here Chapman Field is in this location. The main entrance is at this point, and our main entrance is right in here. So just to give you an orientation in case you have questions or whatever. With that, we were planning to go through -- MR. The first sign that we're looking at -- again, the campus plan is the same as what's up here. Is that Chapman Field? There are several signs that we're looking at. The first one is the Chapman Field scoreboard. Tracy, can you do that? MS. PANZER: That would be number 1. MR. MEDINA: Right. MS. PANZER: Far left. MR. MEDINA: Over in this area is the score board. What we're planning to do is replace it. Hopefully we would like with an electronic version and then one of the things we'd like to do is add the naming rights, the sponsor sign to the board. Questions on that? MR. ROSARIO: May I interject something on that? CHAIRMAN BORTZ: Sure. MR. ROSARIO: Just for the record, that Chapman Field sign is variance number 2011, number 2. MR. MEDINA: The intent would be that it would be illuminated when the scoreboard is on during football games and so forth. MR. TURNER: Internally illuminated? MR. MEDINA: That's our vision, our plan, yes. Jim, did you have something else? MR. FREY: The 24 by two foot, two and a half foot, is just the naming rights portion. MR. MEDINA: Correct. MR. SOKOLOSKI: So the colors could be -- that's just white and red. MR. FREY: It has to be red. MR. SOKOLOSKI: Just asking. CHAIRMAN BORTZ: What's the overall -- MR. SOKOLOSKI: It would look white with red letters basically? MR. MEDINA: That's what we're thinking basically, yes. CHAIRMAN BORTZ: Where does the 720 come from? MR. MEDINA: Where is the 720, Jim? MR. FREY: Wait a minute. The message board, the scoreboard is 36 by 10. And then the message center, which is in the -- where the young man's picture is, that's four foot high. And then the sponsor, the naming rights section is three foot high, and then the Chapman Field is three foot high. So that -- MR. TURNER: 36 by 20. MEDINA: The existing is a little over 600 square feet. CHAIRMAN BORTZ: So what are those dimensions height by width? MR. MEDINA: Let's see. As you can see, the Chapman is a little different. That's actually 24 by two and a half. The -- these advertising signs that are there are 36 feet by two and a half. The black that you see here is actually a message board also. It's 36 by 236 feet by two and a half feet and the scoreboard is 36 feet by ten. CHAIRMAN BORTZ: And then there is a little gap between the two signs. What is that distance? MR. MEDINA: That I don't know. I did not -- CHAIRMAN BORTZ: So the approximate size is very similar to the new sign. MR. MEDINA: Yes. It's very close. It's probably about eight feet off the ground to the bottom. CHAIRMAN BORTZ: Okay. MR. MEDINA: The bottom, that bottom right there. CHAIRMAN BORTZ: Okay. That would be the same for the new sign. Also, it would be eight foot off the ground to the bottom. MR. MEDINA: We would be planning that, yes. We may have to adjust -- from the bottom it should be the same. Since we're adding a little bit here on the naming rights, we may have to do some adjustments above on that. We'll have to determine when we get to that point. MR. FREY: The intent is to utilize the existing support. MR. MEDINA: Correct. MR. FREY: So it won't be any higher than what's there now. MR. MEDINA: Correct. CHAIRMAN BORTZ: Would you continue to put other signage below it like you do have on the existing sign about state champions and so forth? The next one is the concession stand there also at Chapman Field. If you look over at the poster board, if you're familiar, they're near the entrances, home and visitors. And our plan, as you can see, this is the existing. One of the concession stands in our plan would be to put a sign below 16 feet by approximately two feet eight inches. And this states non illuminated. CHAIRMAN BORTZ: And what would be on the sign? What would it be identifying? MR. MEDINA: When we go out with our RP, we'll expect proposals back from various whoever. CHAIRMAN BORTZ: So you expect the business to pay naming rights to back the concession stand? MR. MEDINA: Correct. We would have to work out the timing and fabricate the signs and so forth, yes. MR. FRANKLIN: And the business is picking up the cost of the sign? MR. MEDINA: I believe our plan is that we would pick up their naming -- the costs that we're asking for we expect -- we think will more than cover the actual fabrication. CHAIRMAN BORTZ: What's the physical size of the building, the height and width? MR. MEDINA: Again, that I don't have exactly, but I believe it's about 32 feet wide, and it's just a simple about ten high. MR. FREY: Ten feet. MR. SOKOLOSKI: Are they both the same on both sides of the field? MR. MEDINA: Yes, pretty much. Pretty much the same, yes. MR. ROSARIO: Excuse me. If I may interject. And the intent is to put a sign on each one. MR. ROSARIO: Okay. Okay. CHAIRMAN BORTZ: What would be the construction of the sign? MR. MEDINA: Jim, do you have a feel for that? MR. FREY: Well, right now we're projecting just probably a flat plastic or metal sign. CHAIRMAN BORTZ: All right. MR. SOKOLOSKI: One question I have is: Is the font going to be consistent? Does it matter? Do we have to pick or are you keeping consistent fonts in colors or is everything going to be per whoever gets the naming rights? MR. MEDINA: Our vision is that they'll be some consistency in the font. I think the sizes of the signs, I believe, vary just a little bit, so the signs would be appropriate to the actual sign that we've depicted. That is our proposal. Correct. Again, as I said earlier, we have these draft agreements and RP's. They're not finalized yet so they're taking some form. MR. SOKOLOSKI: So this would be maximum size? MR. MEDINA: Yes. MR. SOKOLOSKI: In other words, it could be smaller. MR. MEDINA: Yes. Conceivably, I guess. MR. TURNER: These signs are oriented toward the inside of the stadium. MR. MEDINA: Correct. The concession stand on the home side is right here and it faces inward. And on the visitor's side it's over on this side, and it faces inward. I don't think you're going to see these signs, these concession signs. MR. TURNER: Okay. MR. MEDINA: No, I don't believe so. MR. FREY: A point of clarification. Dan, would one like the home would be the number 3 and the visitor would be 3A or -- MR. ROSARIO: Well, they're down here as concession stand, two of them. So the concession stands home and visitor would be counted under the variance 2011, number 3. MR. FREY: Okay. MR. ROSARIO: So that would be two signs. MR. FRANKLIN: Okay. MR. MEDINA: During our games, our football games especially, these concession stands get a lot of usage. So the reasoning is that as people walk up to see it, that's more likely when they'll be able to see this. We named it the baseball field, because it is the baseball field. But during other times of the year, this actually doubles as a field hockey scoreboard. That's one of the changes that we identified when we were going through this. That in order to obtain a sign that can double as field hockey and baseball, the dimensions that you see are -- need to be modified. The width needs to be 16 feet. MR. MEDINA: The existing sign is 14 feet. The existing scoreboard -- CHAIRMAN BORTZ: Uh-huh. MR. MEDINA: -- is 14 feet by five feet. CHAIRMAN BORTZ: And how high off the ground? MR. MEDINA: Again, I'm going to estimate that that's probably closer to the 12 foot. CHAIRMAN BORTZ: To the top or the bottom? MR. MEDINA: To the bottom. CHAIRMAN BORTZ: Okay. MR. ROSARIO: That's going to be seven feet tall, the new; is that correct? It's still going to be seven feet tall? It's going to be 16 feet long by seven foot tall? MR. FREY: The scoreboard itself will be seven feet and the Cumberland Valley High School portion there is going to be two foot and then the advertiser at the bottom will be two foot. MR. FRANKLIN: Now, I'm looking at the existing drawing which you just stated your modifications to, and I notice that all three of the components are listed as illuminated; is that correct? MR. FREY: I'm sorry. MR. FRANKLIN: The Cumberland Valley High School part of it and the advertising part of it, in your presentation they're listed as illuminated; is that the intention? MR. MEDINA: As we were going through this planning phase in areas where electricity was readily available, we thought illuminated would be a good selling point. We understand that perhaps that if that's an issue, we can definitely revise it. MR. FRANKLIN: The question, the question that I have on this particular field, there are no lights. MEDINA: It was what we thought would be a good idea. But in retrospect, perhaps it should be rethought. MR. FRANKLIN: Okay. CHAIRMAN BORTZ: It would only be illuminated during the game; is that correct? MR. MEDINA: Yes. We had no intention of having separate switches for the sign versus the advertising or the scoreboard so yes. CHAIRMAN BORTZ: And Mr. Franklin's point, are there any plans to illuminate this field for night games? MR. MEDINA: Not that I'm aware of. CHAIRMAN BORTZ: Okay. MR. FRANKLIN: And is the sign visible from Carlisle Pike? MR. MEDINA: I would say to some extent, yes. CHAIRMAN BORTZ: Can you show us on the satellite view where the location of the sign is? MEDINA: In this particular case, we're going to have do go with a solar package until at some point -- at some point if we ever have to develop the area on the other side, we'll get power there. But right now our thinking is it's the best way to go about it. There are several challenges we investigated trying to get power out there. But there are several challenges that we're not prepared to take on. One of them being there is a gas line, major gas line, that traverses there, which little projects like this, we want to do it, but we found a solar panel that will -- for the battery. They're asking for hundreds and hundreds of square feet of additional signage that the business community in this township can't have. Now that's not right. I can get a variance or not a variance, but a special exemption, and put something out along the road maybe for three months, but I get nothing else. Take a good look at this. You got 500 businesses that I'm going to be out there talking to and saying, "Hey, guys, go for it. It's only your right. You're paying the taxes you get nothing for. Let's do it." This is going to be looked at. This is a lot of signage. And if we get 200,000, okay, per year but, you know, how much of it is going to be used in the right place to reduce our taxes? Instead I've been at the school board for 18 years going to meetings and, boys, I'm going to tell you one thing. They like to spend money at Cumberland Valley. We might be the lowest tax district in this county, but it's only because Cumberland Valley has more businesses than any other school district and we're supporting them. It disappoints me that we're at the point where if a kid goes to a sporting event, they get blasted with billboards. You don't know why things are going to be illuminated for daytime activities. You're proposing a sign in Eagle Stadium that I can tell you is lit up like daytime. It doesn't need any illumination. If you're going to put a sign there, you've put a sign on a fence that currently is bare and you can see through to the wooded area, which is a nice esthetic, especially since that stadium was built adjacent to a nice neighborhood. And I gave the right-of-way, and I didn't sell. I gave the right-of-way for the water discharge so that stadium could be built. But the promise of time was this will be an esthetically pleasing stadium. And now you guys are looking at throwing up a billboard, and that's not esthetically pleasing. It could have been located somewhere else where there is only signage, but you chose to put it where it's going to block the trees, which I don't get the whole esthetic sense. I really question -- I will say that if you guys are going to do this, I'm very glad that my youngest sone is finally graduating, because I send the kids there to school. PIERCE-MCLAIN: I would like to make an opening statement and say that the Board has spent a good bit of time on this. We were very disappointed in Cumberland Valley School District feeling that they have to advertise to the public. We've always considered the high school classic. This is totally classless. It's very tacky, extremely tacky. No other school is doing this. Now, we've read about it in the newspaper that schools want to get out there and do these naming things. And all you're going to do is junk it up, and I mean junk it up. The illumination is out of the question. The people that live in this woman's neighborhood have complained to the Board for several years now about the lights over there. It shines in their homes and in their yards. We have had those complaints for some time. And now if we put this, especially at the Eagle View, that is a big sign. And you illuminate that and that whole place is going to show up. When those lights are on now, you can see the light pollution all over. So that being said, the board went over each sign individually, which I would beg your indulgence and do also. And I will give you a majority vote, not to say they were not a majority. The only sign we agreed on was the sign on the road. And I will say I've been on the Board a long time. And when Tony Clester and Mike Lewis came here asking for the big CV on the building, we were not going to give it. We were not. Because that was totally against our ordinance. And we were very specific about the sign on the road, the entrance sign. But the one that they are proposing -- well, I don't want to go back that far. I'll start with Chapman Field. The majority of the board is okay with the sign for Chapman Field. I think any business that buys the signs on the concession stand needs their head examined. They're not going to see them. There are people standing there all the time. If you're there for a football game, there are people around them, the fence area, and at the concession stands all the time. So anyone who indulges in that is foolish. The signs at the press box, here again the majority of the Board said no to all six of those signs. The baseball, the majority of the Board said, okay, to that, to the naming rights on the baseball field. Number 7, scoreboard, again, illumination is a major problem and we're hoping that the Zoning Hearing Board will take into consideration as they debate the signage. Not only is the illumination a problem, it's also expensive especially with the energy costs today. The sign we have a great deal of problem with is the back of press box. And especially if it's illuminated, so we were totally opposed to that one. Naming rights for the softball field, the majority of the Board agreed to that. Field soccer, which would be number 9. MR. FRANKLIN: That would be the softball scoreboard. MS. PIERCE-MCLAIN: Softball, yes, and the majority of the Board agreed to that. Tennis courts, we see no reason for that. Everybody knows it's a tennis court. I mean, you don't really need to have a sign saying tennis courts. And the only reason they're doing it is the money. And, again, the one I spoke of, I think this naming rights in that new stadium, why did we spend all that money for artificial turf and everything else that we put in there and now we're going put this humongous sign? Absolutely no on that. The soccer field, we did not have a major problem with the soccer field. And as I said, the sign on the road, we don't have a problem with that. PANZER: CV is no different than pretty much every other school district with the proposed state budget in terms of losing funding. We are looking at about 2.3 million dollars in state funding reductions over what we've received in the past year, last year. Looking at our budget from an April 4th update that was presented to the Board during our finance committee meeting. With a tax increase, we're still looking at about a 5.1 million dollar shortfall without a tax increase up to about 6.7. Looking at ways to maintain the quality programming and staffing we have while not -- while possibly minimizing our reliance on our taxpayer dollars. In the April 4th presentation, some of the potential key expenditure reductions could include things such as wage freezes, elimination of positions, administrator, professional and support staff through attrition, deferment of equipment and textbooks, and the elimination of a behind the wheel drivers education program. While we recognize that $200,000 a year won't fill that gap, anything could help. MR. FRANKLIN: Mr. Chairman? FRANKLIN: I guess the thing that I'm struggling with -- and again this gets down to the hardship -- I thought I heard, and please correct me, sir, if I am mistaken, that the taxpayers of the Cumberland Valley School District are still going to be the ones on the hook to pay the costs for these signs, and it is the school district's attempt to try to find someone to sponsor these fields to defray the costs. The question that I'm struggling with in my mind is what is the actual number or what number do you reasonably anticipate to get from this activity and when will you get it? I haven't heard anything here that gives me any comfort that you all really even have a good handle on that yet. MS. PANZER: The cost of the sign come out of the payment that we would receive from our sponsor. MR. FRANKLIN: So, in essence, what you're saying then is that the sponsors would pay for the signs. MS. PANZER: Correct. MR. FRANKLIN: Okay. MS. PANZER: We would purchase them so that we Premier Reporting, LLC Linda C. We don't know that yet. In all honestly, it's also possible that they could come in and say that we'll give you X amount less. And as part of the RFP, we have the right to approve or deny that. MR. FRANKLIN: One of the things -- and I think Mary Lou said it very well. One of the things that this Board looks at whenever someone, anyone, comes to us for a variance request, what is the impact, what is the harm, if the request is not granted. And we have to balance that against what's the impact on the community if it is granted. And you heard from some of your neighbors this evening on that particular point. And that's what this Board is here to weigh. I assure you that I personally and all the Board up here will take a look at each and every one of these and give it the due consideration. I will say, however, that, again, I am concerned with commercialization of that campus. I've had two children go through there. Our school board went through venue by venue. We immediately knocked out any of the academic locations. A library, for example, a cafeteria, we knocked out all of those. Tried to stick more with our athletic venues so that it stays out of the classroom. MR. SOKOLOSKI: And maybe I'm oversimplifying this, but what you said was we're allowing the businesses to another location for a sign. So I'm thinking what Wayne had said. So we're in a township. We're limiting their signage at their place of business, but we're kind of now, if we were to approve this, we would allow them another sign at the school, which doesn't get them to their business. CHAIRMAN BORTZ: Right. MR. SOKOLOSKI: So you said the businesses are paying for the signs. MS. PANZER: Correct. MR. SOKOLOSKI: Maybe I'm oversimplifying it, but that's what it sounds like to me. Who is in the approval process? I mean, we're just one step of the process I would think where the school doesn't just go out and arbitrarily spend money on a sign when they have perfectly good signs there. So what -- educate me a little bit, how does that process work at the school or the school district? MR. MEDINA: What we did is we obtained pricing from various lenders. We put together a recommendation to our board. And they make a decision as to how to proceed, then we implement those decisions. CHAIRMAN BORTZ: Right. But if what she says is true and you have a five to six million dollar shortfall, I would hope you're not going to worry spending money on a sign when they have bigger fish to fry. So I just -- we're trying to weigh the decision process at the school district, you know. So while we may not see or realize a $200,000 savings that first year, you know, we may start to recoup some of those funds in future years. MR. MEDINA: It's a five year contract that we're planning. MS. PANZER; We have a five year contract. CHAIRMAN BORTZ: And today this Chapman Field football stadium sign is a hundred percent functional? There is nothing wrong with it? MR. MEDINA: Yes. Pretty much incandescent bulbs. CHAIRMAN BORTZ: Right. And the same thing with the front entrance sign, that's fine. It just takes someone from manual labor to go out and change the letters. Is that the issue? MR. MEDINA: That is correct. Now, that sign, I wanted to point out it's in the packet, but it is not part of our RFP. CHAIRMAN BORTZ: Yes, but there is no -- MR. MEDINA: My recollection is that a new digital sign like that would be in the order of about 16,000. Don't get -- I'm not actually sure of that number, but I believe that's my recollection right now. MS. DIENER: And that could also be one and a half teaching positions, correct? MR. MEDINA: That's probably about -- MS. LECY: At CV. MS. PANZER: Probably about one if you factor in benefits for one year. That's a one time -- the purchase of the sign would be a one time cost. MR. MEDINA: The marquee sign, there is no advertising there. V 2011-2 thru 2011-14 SCHOOL DISTRICT DECISION DENYING VARIANCES The applicant seeks variances from sign regulations. A hearing on the application was held on April 11, 2011. Although the applicant submitted 13 applications, because they involve similar factual and legal issues, this opinion will address all of the requests. Facts The applicant and owner of the property in question is Cumberland Valley School District of 6746 Carlisle Pike, Mechanicsburg, Pennsylvania 17050. The applicant was represented at the hearing by Joe Medina, Facilities Director, Tracy Panzer, Communications Specialist for the applicant, and James Fry, project architect. 2. The property in question is located on the north side of Carlisle Pike and consists of a multi-acre tract improved as a public school campus. There are three school buildings, an administration building, a district support facility, a stadium, and numerous playing fields. 3. As a revenue generating endeavor, the applicant proposes to erect a number of signs which would include space for advertising by local businesses. The signs would be generally located in connection with athletic facilities. The applicable signs and variance requests are as follows: V2011-2. In connection with the proposed replacement of the Chapman Field scoreboard, the applicant proposes to include a 36 feet by 2.5 feet area for advertising. The overall scoreboard would be 720 square feet. V2011-3. Chapman Field: The applicant proposes two 16 feet by 2 feet 8 inches non-illuminated sign areas below the service counter of the concession stands, one on the Visitor side and one on the Nome side. These signs would be strictly for advertising purposes. V2011-4 and 5. Chapman Field Press Box: Six non-illuminated signs would be placed on or adjacent to the press box above the stadium. Each sign would be 4 feet by 2 feet 8 inches and would be oriented toward the inside of the stadium. The signs would be strictly for advertising purposes. V2011-6. Baseball Field: A 24 feet by 2 feet sign would be added to the top of the backstop for advertising purposes. The sign would be oriented toward the interior of the site and would not be visible from Carlisle Pike. V2011-7. Baseball Field Scoreboard: The existing scoreboard would be replaced and advertising space added. The scoreboard area would be 16 feet by 3 feet topped with an illuminated 16 feet by 2 feet area with the school name. Below the scoreboard would be a 16 feet by 2 feet advertising area which would be illuminated. The field itself is not illuminated. V2011-8. Back of Press Box: One 16 feet by 3 feet illuminated sign is proposed for advertising purposes on the back of the press box. The sign would be 40 feet above the ground and would be visible to westbound traffic on Carlisle Pike. V2011-9. Softball Field: A 16 feet 4 inches by 2 feet non-illuminated sign is proposed for the top of the backstop. This sign is for advertising purposes. V2011-10. Softball Field Scoreboard: A new 8 feet by 7 feet illuminated scoreboard is proposed. The bottom 8 feet by 2 feet portion would be for advertising purposes. The middle 8 feet by 3 feet area would serve as a scoreboard and the top 8 feet by 2 feet area would be for the school name. The field itself is unlit. V201 l -11. Tennis Courts: A 10 feet by 3.5 feet sign would be erected in an archway between two courts. The top of the sign would be for the school logo and the designated "Tennis Courts" while the bottom 1.5 feet by 3.5 feet area would be for advertising. The sign would be illuminated. V2011-12. Eagle View Stadium: A 24 feet by 5 feet illuminated sign would be erected directly across the playing field from the seating area. This sign would be for advertising purposes only. V2011-13. Soccer Field Scoreboard: A 16 feet by 2 feet non-illuminated area would be added to the existing scoreboard for advertising purposes. V2011-14. Main Entrance: The applicant proposes to replace the existing 16 feet by 17.5 feet illuminated sign with a 16 feet by 7 feet sign which would be divided into two portions. The top would be for the school name while the bottom 16 feet by 4 feet area would be an LED message area. This would be used for school purposes only and would contain no commercial messages. 4. The applicant testified that the purpose of the overall sign program was revenue generation although no detailed information regarding costs and potential revenue return was presented, nor were contracts in place. 5. Appearing at the hearing were several concerned residents. Wayne Stevenson of 49 Texaco Road objected to the amount of commercial advertising proposed in relationship to the commercial advertising allowed to local businesses under the ordinance. Tricia Lacy, an adjoining property owner, expressed concern about the commercialization of an educational institution, and in particular to the negative effects upon the landscape of the Eagle View sign. A representative of the Board of Supervisors expressed opposition by the Board to a number of the signs which were primarily for advertising purposes. 6. Notice of the hearing was posted and advertisement made as required by the ordinance. Conclusions 1. Section 313.3 of the ordinance establishes standards for the maximum number of signs, maximum sign area and maximum height of freestanding signs. This section of the ordinance would be violated by the proposed sign package. 2. Section 604.4 of the ordinance grants the Board the power to grant variances where the provisions of the ordinance inflict unnecessary hardship upon the applicant. 3. The Board funds that the applicant has presented no evidence of hardship unique to the land which would justify the requested variances. There are no irregularities of shape, size or topography which prevent the reasonable use of the property. In fact, it is already extensively developed as an educational campus. The signs in question are not necessary to accomplish that purpose. 4. Granting the variance would alter the essential character of the neighborhood and be contrary to the spirit and intent of the ordinance. The signs are of a commercial nature and contrary to the campus-like nature of the subject property. The total package is in excess of that allowed to commercial businesses and there is no logical reason for allowing business owners to erect commercial signs on a school property in excess of the signs allowed on their commercial properties. Decision In view of the foregoing and having considered the plans and testimony submitted to the Board, it is the opinion of the Board that the variances requested should be and are hereby denied.
