COMPLAINT
NOW COMES Plaintiff Jennifer Sheriff, by her attorney, Jesse Raymond Ruhl, Esquire,
and files the within Complaint as follows:
1. Plaintiff is an adult individual with an address located at 390 Rich Valley Road,
Carlisle, PA 17013.
2. Plaintiff is in the business of providing residential residences for lease.
3. Defendant is an adult individual with an address located at Lot M87, 3450
Mountain Road, Shartlesville PA 19554.
4. Defendant leased the premises from Plaintiffpursuant to a lease agreement, a tree
and correct copy of which is attached hereto at Exhibit "A" and incorporated herein by reference.
5. Pursuant to the lease agreement, Defendant was required to use care in
maintaining the welfare and integrity of the premises.
6. Pursuant to the lease agreement, Defendant also agreed to surrender the premises
to Plaintiffat the expiration of the lease agreement in the condition in which the premises were
given to Defendant.
7. Pursuant to the lease agreement, Defendant also agreed to pay for damages she
caused to the premises.
8. Defendant caused damages to the premises in the amount of $5,211.05 because on
January 1,2001, she failed to maintain heat in the premises.
9. Specifically, because she failed to maintain heat, the water pipes froze in the
apartment, causing the repairs described in Exhibit "B' attached hereto and incorporated herein
by reference.
10. Defendant has failed and or refused to reimburse Plaintiff for these repairs.
11. Failure to reimburse Plaintiff for these repairs was a breach of the lease agreement
for which Plaintiffhas been damaged.

WHEREFORE Plaintiff Jennifer Sheriff demands judgment in her favor and against
Defendant together with costs of suit and interest.

ANSWER TO COMPLAINT
This le~er is written in order for mc to post my objectiens to the lawsuit.
At the time of this incident, (pipes ~ezing) there was no Isose in effect. The copy of the lease that is
attached to the packet i received ended in September of 2000, also, there is no mention within the lease
regarding the utilities.
At no point in tile was I asked to pay for these damages, il the ciltrnty Jen Sheriff, herself informed me
that her insm'ence had covered the damages. The only thing that she requested of me was an additional
$350.00 in security deposit in order for her to cover her deductible, which made a $1000.00 total in security
deposit. Folinwlns this incident, at the end of Jentmry, 2001, I signed a new lease, and still there was no
request for payment for these damages.
This was not the first time that this has happened. The previous year, because of the pipes freezing, I
would have t~ leave the bathroom faucet run in order to prevent the pipes from fleeting. These are plastic
pipes with no insulation in the ceiling. The only pipes that ~oze in the house was the shower due to lack of
insulation in thc ~eiling. The neighbor also informed Jen that their pipes froze as well.
Following this incident, I was told I would be out of the apartment for 7 - I0 days to repair the apartment in
which time I signed a new lease, however, alter 2 months time, the property still was not fixed. So I was
~'ced to look for othor residenea due to the fact that the repairs were not mede.
Therefore, alter all of this, I feel that I do not owe this money.
