AND NOW, this ~ day of , 2011, upon consideration of the
Petition for Appointment of a Permanent Plenary Guardian of the Person and Estate of
Myles J. Clapsadl pursuant to 20 P.S. Section 5511, and following a hearing at which
Myles J. Clapsadl was present and at which he was represented by court appointed
counsel, Mark F. Bayley, Esquire, and at which evidence was presented by the Petitioner
in support of the Petition, and, based upon the foregoing, the Court finds:
1. That Myles J. Clapsadl is an incapacitated person in that he suffers from a
mental impairment that prevents him from receiving and evaluating information
effectively and prevents him from formulating and communicating decisions to such a
significant extent that he is unable to manage his financial affairs or meet essential
requirements for his physical health and safety on a daily basis, and is adjudicated as
such.
2. That the Court appoints Michael A. Clapsadl and Jo Ellen Clapsadl as
Permanent Plenary Guardians of the Person and Estate of Myles J. Clapsadl. No bond
shall be required to be filed.
3. That the Guardians shall file on a timely basis with the Court all reports
and accounts required by statute.

Per your request I am writing to summarize my findings on Mr. Myles Clapsadl. I am a clinical
neuropsychologist who has evaluated Mr. Clapsadl multiple times since 2008 when he was referred to me for
evaluation by his pediatric oncologists.
Mr. Clapsadl carries a diagnosis of Langerhans cells histiocytosis with CNS progression which was initially
diagnosed in 1994-1995. This is a neuro-degenerative disease, meaning a disease which causes progressive
physical and mental deficits, for which there is no cure. However, several possibly effective chemotherapies
have been tried to slow the progression of the disease, with the understanding that nothing will be curative.
Mr. Clapsadl was referred to me initially in 2008 for a baseline assessment before beginning an
immunosuppressive chemotherapeutic agent, tacrolimus, known to cause additional neurocognitive
impairment. In 2009 they added IVIG chemotherapy treatments, and in 2010 they added cladribine.
Physically, since 2008 Mr. Clapsadl has progressed from being able to walk independently to being wheelchair
dependent in most situations.
Neuropsychologically, Mr. Clapsadl has undergone five neuropsychological assessments on the following
dates under my supervision:

• 5/28/2010
• 12/1/2010
Mr. Clapsadl's current neurobehavioral problems include medication-resistant depression, extreme behavioral
disinhibiticn (primarily sexua!), and pseudobulbar affect. Although n;s IQ per se has not declined over the time
I have evaluated him, he has shown a significant impairment in judgment and behavioral self-control. He also
has severe deficits in attention and short-term memory which have declined over time. Although he has a
relative strength in problem-solving ability, he appears to have used this strength to circumvent social mores
such as texting inappropriate sexual messages, rather than to learn to care for himself better. Myles shows
specific deficits in tasks which involve the right frontal lobe of the brain (such as memory for faces) which also
govern behavioral control. Therefore, I conclude that his behavioral disinhibition is related to the area of the
brain which has been impaired by his degenerative disease.
Unfortunately, Mr. Clapsadl's prognosis is poor. Due to his disease, his brain will continue to degenerate and
cause additional physical and cognitive and behavioral impairment. Mr. Clapsadl's memory impairments mean
that he will not be capable at this point of learning any significant new life-care skills.

Chicago Supportive Oncology Conference 2nd Annual (2006). This conference has oncologists as the primary
target audience, but it also includes palliative care and primary care physicians as well as nurses, pharmacists, etc. t
was invited to (and did) give a 20 minute talk from 10:40am-1 1:00 am on Friday, September 29`h 2006 on the topic
of "Rehabilitation of QOL After Surgery for Brain Tumors". The talk was then reported in the Journal of
Supportive Oncology (Feb, 2007) volume 9, no 2. "Rehabilitation after brain cancer surgery" p. 3
Congress of Neurological Surgeons (2007). spoke at the annual CNS meeting, at the CNS Neurosurgical Forum on
",Navigating Clinical Trial Design and Participation" on Monday, September 17, 2007 titled "How
Neurocognitive Endpoints May Change Clinical Trial Designs".
Society for Neuro-Oncology (2008). I was asked to speak at the Education Day on Quality of Life, to moderate the
session, and give a 20-minute talk on "State of the QOL Science and Future Directions" and also to speak at the
Sunrise Session on "Neurocognition and Quality of Life" Nov 20 2008.
World Federation of Neuro-Oncology (2009). I was an invited speaker for this SFNO meeting in Yokohama Japan
May 10-14 2009. I gave a lunchtime seminar titled "How neurocognitive outcomes can change clinical trial design"
and was sponsored by the Mitsubishi Tanabe Pharma Corporation on May l4, and I gave a Lecture Open to the
Public (simultaneously translated) called "Caring for the Caregiver" on May 12.

Optional Session: NCI Research Priorities -under discussion was whether neurocognitive information is
ready for use as a primary endpoint in a brain tumor clinical trial. I made comments from the audience.

Frye Halloran Dana Farber Cancer Institute Symposium Oct 2 2008. The purpose of this meeting was to gain a
shared understanding of the current state of knowledge, the existing barriers to more successful treatments,
and the future goals for treating brain metastases in patients with breast cancer. The meeting brought
together experts in basic and clinical sciences to build a framework for developing innovative and effective
new therapies for brain metastases. [spoke about how to measure neurocognitive endpoints in cancer
clinical trials.

THE SCHOLARSHIP OF TEACHING AND LEARNING
Courses taught in resident instruction at Penn State for each semester with enrollments in each course
MSI[1: Third-year Primary Care Clerkship's Communication Seminar titled, Communicating with Patients
in Problem Clinical Encounters. The purpose of the Primary Care Clerkship is to give third-year medical
students the chance to learn effective communication skills, and explore the complex and challenging
issues of communicating with patients. This course is designed to serve as a "graduate level course in
communication" by identifying problem clinical encounters (such as the angry, demanding patient) and
teaching students effective ways of dealing with them. A review of effective communication skills and a
discussion of the physician's role in healing are incorporated into the instruction. This is a required part of
the Primary Care Clerkship and takes place on the last Thursday of their 4-week rotation. The number of
students ranges from 8-14. 2007-present

PATIENT CARE ACTIVITIES
Statement of clinical assignment, including time commitment
• [was hired May 1, 2005 in the PSUHMC Department of Neurosurgery as aclinician-scientist. My work is
split roughly 40% clinical (two clinic days a week) and 60% research (three days a week for research and
any administrative meetings and teaching). However, since my research patients are part of clinical
research (usually without changing standard of care) these divisions are not always strictly delineated.
Extent of effort; number and complexity of cases
• Inpatient: Inpatient consults at request of other Neurosurgery attendings. Involves inpatient
neuropsychological evaluations, patient and family education, coordination of outpatient evaluations and
treatment. Reasons for consults include: appropriate discharge disposition given cognitive/psychiatric
impairment, evaluation of competency, establish longitudinal neuropsychological care, etc.
• Outpatient: Approximately six full outpatient neuropsychological evaluations per week, with 2-3 additional
brief evaluations (e.g., dementia evaluations), 3-4 hours a week in feedback counseling sessions.
• Cases tend to be both medically and neuropsychological very complex; diagnoses include brain tumors,
hydrocephalus, aneurysms, and traumatic brain injury.

• As a cognitive neuroscientist and recently new mom I was interviewed for my opinions re: the "Mommy
Brain" book by Katherine Ellison published April 2005. l supported the thesis of the book which is that
having a child doesn't make you less smart (outside the sleep-deprivation) and the long-term benefits are
that one's abilities in terms of complex problem solving improves along with an ability to manage swings
of emotions in others.
