sound and disposing mind and ms~ory, do hereby make, publish and
declare this instrument to be my LAST WILL AND TESTAMENT.
FIRST. I hereby revoke any and all wills aD~i codicils by me
heretofore made.
SECC~D. I direct that all my just debts and funeral
expenses be paid as so~n as co~r~e~iently can be done after my
death.
~IRD. I give, devise and bequeath all my estate and
property including all property of which I shall die seized and
possessed, all uroperty to which my estate shall be otherwise
entitled at the time of my death, and all property over which I
shall have po~_r of appointment, of whatsoever kind or nature and
wheresoever situated, be it real, personal or mixed, absolutely and
forever, to my wife, MARY E. ~, if she survives me.
FOURTH. In the event my wife, MARY E. KCNETSKI, predeceases
me, I give, devise and bequeath all my estate and property, in equal
share, absolutely and forever to my child~-~, DORIS E.
MARIAN E. ~ALTER, MARK L. ~, JCN M. ~, and DAVID S.
~, but if any of my children predecease me, the~ to the heirs
of such child or children who are living at my death, such heirs to

children predecease me and are not survived by heirs, then the
share of any such child or children shall lapse and shall be divided
among my surviving children and the heirs of any of my children who
have not survived me, such heirs to take per stirpes and not per

FIFTH. In nc~inate, constitute and appoint my wife, MARY
E. Kf~ETSKI, as E~=cutrix of this Will. In the e~-~t she shall
predecease me, or fail to qualify or ccmplete the administration of
my estate, then I appoint my daughter, DCRIS E. MURPHY, to serve as
Executrix of this Will. I request that the Executrix be penm~tted
to serve without bond and without fuznishing any other security. I
further direct that the Executrix be allowed to serve without the
intervention of any court except as re~,~ red by law.
SIXTH. I give my said Executrix, absolute discmetion and
the fullest authority in all matters including, but not limited to,
c~]-~lete authority to sell at public or private sale, for cash or
credit, with or without security, mortgage, lease, and dispose of
all property, real, personal or mixed, at such times add upon such
te~ms and conditions as she shall determine to be in the best
interest of my estate. I direct that the administration of my
estate be as independent of probate proceedings as the laws in force
at my death shall permit.

declar~ this instrument to be my LAST WTT,T. AND TESTAMENT.
FIRST. I he~ r~voke any and all wills and codicils by n~
heretofore made.
SECOND. I d~rect that all my just debts and funeral
expenses be paid as soon as conveniently can be done after my
death.
THIRD. I give, devise and bequeath all my estate and
property including all pru~_rty of which I shall die seized and
possessed, all property to which my estate shall be otherwise
entitled at the time of my death, and all property over which I
shall have pc~_r of appointment, of whatsoever kind or nature and
wheresoever situated, be it real, personal or mixed, absolutely and

FOURTH. In the event my wife, MARY E. KONETSKI, predeceases

KONETSKI, but if any of my childrs~ predecease me, then to the heirs

E. KONETSKI, as Executrix of this Will. In the event she shall
predecease me, or fail to qualify or c~lete the administration of
my estate,' then I appoint my daughter, DORIS E. MURPHY, to serve as
Executrix of this Will. I r~quest that the Executrix be permitted
to serve without bond and without furnishing any other security. I
further dj rect that the Executrix be allowed to serv~ without the
intervention of any court except as rec~ red by law.
SIXTH. I give my said Executrix, absolute discretion and
the fullest authority in all matters including, but not limited to,
c~lete authority to sell at public or private sale, for cash or
cra/it, with or without security, mortgage, lease, and dispose of
all property, real, perso~a] or mixed, at such times and upon such
te~ms and conditions as she shall detennine to be in the best

WHEREAS, LEONARD V. KONETSKI, late of Fairview Township, Cumberland
County, Pennsylvania, died testate on April 7, 2003.;
WHEREAS, Letters of Administration on the estate of said LEONARD V.
KONETSKI, were duly issued by the Register of Wills of Cumberland County, Pennsylvania, unto
DORIS E. MURPHY, on April 11, 2003;
WHEREAS, DORIS E. MURPHY as Executrix of the Estate of LEONARD V.
KONETSKI has gathered the assets of the Estate, which consist of personal property as disclosed
to the parties;
WHEREAS, the debts and deductions, including payment of the Pennsylvania
Inheritance Tax in said Estate as well as the payment of the Federal and State Income Taxes,
have been paid as disclosed to the parties;
WHEREAS, it is the desire of the undersigned that distribution be made without the
formality of an accounting, and the said DORIS E. MURPHY, is willing to make such distribution
upon receipt of a proper release and indemnification, which it is the purpose of this Agreement to
provide.
NOW, THEREFORE, KNOWN YE that WE, DORIS E. MURPHY, MARK
KONETSKI, MARIAN KONETSKI WALTER, JON KONETSKI, and DAVID KONETSKI, the
residual beneficiaries of the Estate of LEONARD V. KONETSKI, do hereby acknowledge that we
have this day had and received from the aforesaid Executrix in full and final satisfaction and
payment of all sum or sums of money, the amount of distribution which is set forth next to our
names on the attached Exhibit "A", which is a statement of the distributions of the Estate of
LEONARD V. KONETSKI;
In consideration of the delivery to us of the distribution as aforesaid, for ourselves,
our heirs, executors, Executrixes and assigns, we do remise, release, quitclaim and forever
discharge DORIS E. MURPHY, individually and as Executrix of the estate of LEONARD V.
KONETSKI, from any and all actions, suits, payments, accounts, claims and demands whatsoever
or by reason of her administration of the Estate of LEONARD V. KONETSKI, Deceased, hereby

We further agree to indemnify and hold harmless DORIS E. MURPHY from any
and all claims, loss, liability and damage which she may suffer or to which she may be subjected
by reason of the settlement of this account and distribution of the assets of the estate of
LEONARD V. KONETSKI without Court approval.
We do further declare it is our intention to be legally bound by the execution of this
instrument and do hereby covenant and agree with the said Executrix that should any liability
come known against the Estate of LEONARD V. KONETSKI after the signing of this Agreement,
we will satisfy any and all claims, demands, suits or causes of action which may be successfully
prosecuted against the Estate of LEONARD V. KONETSKI, Deceased, or the aforesaid Executrix
in her capacity as such after the signing and delivery of this Receipt, Release and Reimbursement
Agreement.
