I, MARIAN J. FORTNEY, of the Borough of Mechanicsburg, County of
Cumberland and Commonwealth of Pennsylvania, being of sound and disposing
mind, memory and understanding, do make, publish and declare this as and for my
Last Will and Testament, hereby revoking and making void all former wills and
codicils by me at any time heretofore made.
FIRST. I order and direct that all my just debts and funeral expenses be
paid by my Co-Executors, hereinafter named, as soon as conveniently may be
done after my decease.
SECOND. I give and bequeath the sum of Two Thousand and No/100
($2,000.00) Dollars unto my brother, WILLIAM R. JACOBY, of San Antonio, Texas,
absolutely, if he survives me, in gratitude for the special care and assistance that
he provided to me when I needed it.
THIRD. I give and bequeath the sum of Two Thousand and No/100
($2,000.00) Dollars unto my good friend, REBECCA WOODS, of Boynton Beach,
Florida, absolutely, if she survives me.
FOURTH. I give and bequeath the sum of One Thousand and No/100

A. I give and bequeath an amount equal to one-half (1/2) of my said
estate unto my son, WILLIAM B. FORTNEY, of Garland, Texas, absolutely
and in fee simple, if he survives me. Provided, however, that if my son shall
predecease me leaving lawful issue to survive me, then the share provided
herein for him shall be paid over and distributed unto his said lawful issue
per stirpes, said issue to take the ancestor's share by representation and
not per capita;
B. I give and bequeath an amount equal to one-fourth (1/4) of my
said estate unto ROBIN B. FORTNEY, of Des Moines, Iowa, widow of my
late son, JAMES A. FORTNEY, absolutely and in fee simple, if she survives
me. If she does not survive me, then this bequest shall lapse and an
amount equal to two-thirds (2/3) of said bequest shall be distributed under
the terms and conditions of Sub-paragraph A., above; and an amount equal
to one-third (1/3) of said bequest shall be distributed under the terms and
conditions of Sub-paragraph C., below.
C. I give and bequeath an amount equal to one-fourth (1/4) of my
said estate in equal shares unto my grandchildren, namely: BRIAN
FORTNEY, BRENT FORTNEY, BRAD FORTNEY and BRENDA MAHONEY,
share and share alike, absolutely and in fee simple. Provided, however,
that if any of my grandchildren shall predecease me leaving lawful issue to
survive me, then the share provided herein for such grandchild shall be paid

over and distributed unto his or her said lawful issue per stirpes, said issue
to take the ancestor's share by representation and not per capita.
LASTLY. I nominate, constitute and appoint my son, WILLIAM B.
FORTNEY, my former daughter-in-law, ROBIN B. FORTNEY, and my great-
nephew, BRANDY C. COOK, Co-Executors under this, my Last Will and
Testament, all to serve without bond in this or any other jurisdiction. If any of them
shall fail to qualify as such Co-Executor or cease so to serve, it shall not be
necessary to appoint a substitute Co-Executor to serve in his or her place, but in
such event my remaining Co-Executors (or Executor, as the case may be) shall
serve with full power and authority under this, my Last Will and Testament.
IN WITNESS WHEREOF, I, MARIAN J. FORTNEY, have hereunto set my
hand and seal to this, my Last Will and Testament which consists of three (3)
typewritten pages to each of which I have affixed my signature this
