CIVIL ACTION - LAW
COMPLAINT
The Plaintiff is an adult individual residing at 32 Carlisle Road, Newville,
17241.
Defendant Scott A. Dover is an adult individual residing at 606 Ora Circle,
Waynesville, North Carolina 28786.
3. USA Truck, Inc. is a corporation having its principal offices located at
4303 N. Main Street, Peoria, Illinois 61611.
4. The facts and occurrences hereinafter related took place on or about
December 21, 2003 on Route 11 in Middlesex Township, Cumberland County,
Pennsylvania.
5. At the time and place aforesaid, the Plaintiff was the owner of a 1998
Ford sedan which was then and there proceeding south on Route 11 with a green traffic
light.
6. At the time and place aforesaid, Defendant Dover was the operator of a
tractor trailer owned by Defendant USA Truck, Inc., and he was proceeding southbound
on Route 11 when he collided with the rear of the Plaintiff's vehicle pushing it into
another vehicle and causing the damages hereinafter set forth.
7. At all times relevant hereto, Defendant Dover was the agent, servant or
employee of Defendant USA Truck, Inc. and acting within the scope of such agency or
employment.
8. The aforesaid accident and damages resulting therefrom were caused by
the negligence of Defendant Dover in that he:
a) failed to keep a proper lookout for other vehicles;
b) operated his vehicle at a speed too fast for conditions then and there
existing; and
c) operated his vehicle at a speed so as to be unable to stop within the
assured clear distance ahead.
9. Solely as a result of the Defendant's negligence, Plaintiff's vehicle
sustained damages totaling SEVEN THOUSAND ELEVEN and 70/100 ($7,011.70)
DOLLARS.
WHEREFORE, Plaintiff demands judgment against the Defendants in an amount
not in excess of mandatory arbitration limits.
