Pennsylvania, a sui juris individual, is the sister of Barbara A. Riggleman.

Pennsylvania, a sui juris individual, is the brother of Barbara A. Riggleman.
3. Barbara A. Rigglema~l, born July 27. 1955, is a 55 year old single woman who resides
with her mother, Fern E. Riggleman at 86 Fairview Street, Carlisle, Cumberland County.
Pennsylvania.
4. Barbara A. Riggleman, an incapacitated person, was adjuged incompetent under the
then statutory authority governing such proceedings. A copy of said Order is attached hereto.
incorporated by reference and marked Exhibit "A".
5. The Court Order named Dauphin Deposit Bank and Trust Company as guardian of the
estate of Barbara ~. Riggleman.
6. No one was appointed as guardian of the person of Barbara A. Riggleman.
7. The proposed Guardians have no interest that is adverse to those of Barbara A.
Riggleman.
K. The Petitioners are willing to serve as Guardians of the Person of Barbara n.
Riggleman, and have signed a consent letter which is attached hereto, incorporated by reference
and marked Exhibit "B'".
9. The consents of the mother and remaining sibling of Barbara A. Riggleman are
attached to this petition as Exhibit "C".
10. It is the position of the Petitioners that Guardianship is necessary in order to secure
medical and social services on behalf of Barbara A. Riggleman.
1 l . No other petition has been filed for the appointment of a Guardian of the Person for
Barbara A. Riggleman.

PETITION OF GUARDIAN TO EXPEND PRINCIPAL
FOR THE BENEFIT OF AN INCAPACITATED PERSON
AND NOW, comes the guardian, M&T Bank, successor by merger to Dauphin Deposit
Bank and Trust Company, by and through its attorney, Susan J. Hartman, Esquire, and requests
the Court to enter an Order for the expenditure of principal on behalf of an incapacitated person
based upon the following:
1. The Petitioner is M&T Bank, successor by merger to Dauphin Deposit Bank and Trust
Company (herein "Bank"), a bank authorized to do business in the Commonwealth of
Pennsylvania with a local mailing address of One West High Street, Carlisle, Cumberland County,
Pennsylvania and a corporate address of One M&T Plaza, Buffalo, NY 14203.
2. The incapacitated person, Barbara A. Riggleman, born July 27, 1955, is a 55 year old
single woman who currently resides with her mother, Fern E. Riggleman, at 86 Fairview Street,
Carlisle, Cumberland County, Pennsylvania, Charles J. Riggleman having died June 19, 2010.
3. Bank was appointed guardian of the Estate of Barbara A. Riggleman by Order of this
Court dated July 17, 1989. following a hearing wherein Barbara A. Riggleman, the incapacitated

person, was adjudged incompetent under the then statutory authority governing such proceedings,
a copy of said Order is attached hereto, incorporated by reference and marked Exhibit "A".
4. Barbara A. Riggleman continues to be incapacitated.
5. Bank has invested and managed the trust placed in its hands and there is currently
approximately Ninety Thousand and no/100 ($90,000.00) Dollars in the Trust fund.
6. Under an Order of Court dated July 29, 1998, Bank is authorized to pay Five Hundred
Fifty and no/100 ($550.00) Dollars per month to Fern E. Riggleman for the care and maintenance
of Barbara A. Riggleman out of principal and interest. A copy of the Order is attached hereto,
incorporated by reference and marked Exhibit "B".
7. Fern E. Riggleman is currently 79 years of age and is the sole provider of care for
Barbara A. Riggleman.
8. Bank wishes to make provision for Barbara A. Riggleman in the event Fern E.
Riggleman is no longer able to provide for the care and maintenance of Barbara A. Riggleman.
9. Section 5536 of the Decedents, Estates and Fiduciaries Code, 20 Pa. C.S. section 5536
provides, inter alia, as follows:
The Court for cause shown and with only such notice as it considers
appropriate in the circumstances, may authorize or direct the payment or application
of any or all of the income or principal of the estate of an incapacitated person for
the care, maintenance or education of the incapacitated person..."
10. Bank deems it necessary and appropriate to expend principal to supplement annual
income in order to provide for payment of the following expenses:
A. Prepayment of funeral expenses to Ewing Brothers Funeral Home in the amount of
$8,981.00. A copy of the quoted expense is attached hereto, incorporated by reference and
marked Exhibit "C".
B. Prepayment for a memorial marker with engraving to Cumberland Valley Memorial in
the amount of $3,090.00. A copy of the quoted expense is attached hereto, incorporated by
reference and marked Exhibit "D".
C. Swaim Health Center, located in Newville, Cumberland County, Pennsyh-ania, as
agreed to accept Barbara A. Riggleman as a resident in the event Fern E. Riggleman is no longer
able to care for her. Bank is seeking advance authorization to pay for the expenses associated
with said residential care, whether it be to Swaim Health Center or another facility, when said
placement becomes necessary, since it is likely that such placement may be on an emergency basis.
D. Attorney's fees and filing costs.
11. Barbara A. Riggleman has no issue; her sole next of kin is her mother, the direct
intestate heir, and three (3) siblings.
12. Barbara A. Riggleman has insufficient other income to pay the expenses for which
Bank seeks to expend principal.
13. The current designated representative payee for social security benefits to Barbara A.
Riggleman is Fern E. Riggleman.
14. M&T Bank seeks authorization from the court to designate a representative payee for
social security benefits in the event Fern E. Riggleman is no longer able to perform such duties.
WHEREFORE, your Petitioner requests an Order authorizing the expenditure of
principal as set forth herein, for permission to designate a representavie payee for social security
benefits and for such other relief as the Court deems appropriate under the circumstances.

to Ewing Brothers Funeral Home in the amount of $8,981.00. 2) Prepayment for a memorial
marker to Cumberland Valley Memorial in the amount of $3,090.00. 3) Authorization to pay for
the expenses associated with said residential care, whether it be to Swaim Health Center or
another facility; upon payment of same, monthly payments in the amount of $5.50.00 per month
to Fern E. Rigglemen shall be terminated 4) Attorneys fees inet.irred in the within proceedings.
Furthermore, M&T Bank is authorized to designate a representative payee for the purpose of
recei~~ing social security benefits inuring for the benefit of Barbara A. Riggleman.
