FINAL DECREE
AND NOW, this 8th day of July, 2011, after
hearing at which the Alleged Incapacitated Person was not
present, but at which he was represented by court-appointed
counsel, Michael Palermo, Esquire, it is hereby ordered and
directed as follows:
1. We are satisfied that David BenAmi is an
Incapacitated Person in that he suffers from a mental impairment
that prevents him from receiving and evaluating information
effectively and prevents him from formulating and communicating
decisions to such a significant extent that he is unable to
manage his financial affairs or meet essential requirements for
his physical health and safety on a daily basis, and he is so
adjudicated.
2. Cumberland County Aging & Community Services is
appointed as Permanent Plenary Guardian of the Person and Estate
of David BenAmi. No bond shall be required to be filed.
3. The Guardian of the Person and Estate of David
BenAmi shall keep his brother, Alfred Means, Sr., and any other
relative that requests information apprised of the Incapacitated
Person's condition, including any changes in his medication or
any substantial deterioration or improvement in his condition.
Furthermore, the brother and any other blood relative shall be
entitled to visit with the Incapacitated Person and take him out
of the nursing home for reasonable periods of visitation.

4. The Guardian shall file on a timely basis with
the Court all reports and accounts required by law.
5. The fee for services of Michael Palermo, Esquire,
shall be paid from the Estate of the Incapacitated Person.
