AND NOW COMES THE PETITIONER, the Area Agency on Aging, in and for
Cumberland County, Pennsyivania, by its solicitor, Anthony L. DeLuca, Esquire, who
represents and avers as follows:
The Petitioner is the Area Agency on Aging, in and for Cumberland County,
Pennsylvania, with its office located at 16 West High Street, Carlisle, Cmnberland
County, Pennsylvania.
The alleged incapacitated person is Mary Weaver, age 68, who currently resides
at 650 North College Street, Carlisle, Cumberland County, Pennsylvania and has residcd
there for a period exceeding 1 year prior to the filing of this Petition.

The Petitioner is not related to Mary Weaver.
5.
The etlt~oner s interest is that ora welfare agency concerned with her welfare
and is familiar with her case.
6.
Mary Weaver has, for at least three (3) months, been incapable of managing and
caring for herself and her financial affairs.
7.
Mary Weaver exhibits symptoms of mental incapacity, including but not limited
to extensive cerebella dysfunction, and also oral tremor, ataxia.
8.
Mary Weaver's mental incapacity prevents her from managing and caring tbr the
affairs of her person and estate.
On or about August 6, 2004, the Petitioner received a report for need of Protective
Services for Mary Weaver.

Mary Weaver, the alleged incapacitated person, resided at 650 North College
Street, in Carlisle, Pennsylvania with her brother, Arthur Weaver.
11.
The house has been condemned as being unfit for human habitation and her
brother, Arthur Weaver, ,,vas arrested on August 5, 2004 for failure to appear and is
currently in Cumberland County Prison.
12.
A number of notices have been posted against the property at 650 North College
Street, Carlisle, PA for codes xqolations.
13.
At the time Arthur Weaver was arrested by the police, Mary Weaver was fotmd in
the house and taken to Carlisle Hospital by ambulance.
14.
When Mary Weaver arrived at the hospital, the follo~ving observations were noted
on her medical chart:
a. Her finger nails on three of the fingers of each hand were 3 to 4 inches
long;
b. Her big toe nail was about al~ inch long;
c. She was confused, smelled of urine, was xvearing dirty clothes with insects
running around her body; and feces were matted in her hair.

An examination by neurologist, Craig Jurgensen, M.D., reflects that Mary Weaver
has central nervous system atrophy with physical wasting and has extensive cerebella
dysfunction, including oral tremor and ataxia.

Craig Jurgensen, M.D., further advised that Mary Weaver is incapable of making
medical, personal or financial decisions and is mentally and physically incompetent.

Family members state that Mary Weaver began experiencing some type of mental
or neurological problems when she graduated from high school, was never formally
diagnosed and remained living at home.
18.
Her brother, Russell Weaver, has stated that his sister had been hospitalized for
mental health reasons in 1997 or 1998.

A family friend has stated that Mary Weaver has no clothes or shoes of her own

Prior to the death of her last parent, a Trust Fund was established in the name of
Mary Weaver and the Trustee is Roger Irwin, Esquire.
21.
According to Attorney Irwin the Trust Fund is currently worth about $l 1,000.00
and her sole source of income comes from the interest earned off the Trust Fund, which
interest is approximately $I00.00 a year. She has no social security income.
22.
Petitioner believes and, therefore, avers that Mary Weaver's income consists of
approximately $100.00 a year earned from the interest generated by the $11,000.00 Trust
Fund.
23.
Petitioner requests that it be appointed Plenary Guardian of the Person on both an
emergency and permanent basis.
24.
Petitioner requests that Roger Irwin, Esquire be appointed Plenary Guardian of
the Estate on both an emergency and permanent basis.
25.
The proposed Guardians have no interest which is adverse to thc interest of Mary
Weaver.
26.
Petitioner believes, and, therefore avers that Mary Weaver does not already have a
Guardian.
27.
Petitioner asserts that Mary Weaver is incapacitated as defined in Chapter 55 of
the Probate Estates and Fiduciarics Code.
28.
Because of her impaired mental and physical condition, Mary Weaver lacks the
capacity to provide for her own personal care and maintenance.
29.
Because of her impaired mental and physical condition, Mary Weaver is unable to
manage her financial affairs, property and business and to make and communicate
responsible decisions relating thereto.
30.
A power of attorney would be a less restrictive alternative than Guardianship but
Mary Weaver currently does not have an attorney-in-fact and she lacks the capacity, at
present, to appoint one.
31.
To Petitioner's knowledge, no previous application has been made for the order
herein requested or for a similar order.
32.
No other Court has ever assumedjurisdiction in any proceeding to determine the
incapacity of Mary Weaver.
33.
Mary Weaver is due to be discharged from Carlisle Regional Medical Center at
any time and, upon discharge from the hospital, Petitioner believes, and, therefore, avers
that Mary Weaver would be at imminent risk of serious bodily harm because she has no
place to go and no one to care for her.

The failure to appoint Petitioner as Emergency Plenary Guardian of the Person of
Mary Weaver and later as Permanent Plenary Guardian of her Person and Roger Irwin,
Esquire as Emergency Plenary Guardian of her Person and later as Permanent Plenary
Guardian of her Estate xvill result in irreparable harm to the person and estate of Mary
Weaver.

To eliminate the imminent risk of harm to Mary Weaver, Petitioner, if appointed
as the proposed emergency and permanent plenary guardian of her person will seek to
immediately place her in a nursing home facility because that is the least restrictive
alternative available for her.
WHEREFORE, the Petitioner respectfully requests that:
I. The Court appoint the Area Agency on Aging, in and for Cumberland
County, Pennsylvania as emergency plenary guardian of the person of Mary Weaver
pending a final hearing on this Petition with such emergency guardian having full power
to place Mary Weaver into a nursing home facility and such other poxvers and restrictions
the Court dce~ns proper;
2. The Court appoint Roger Irwin, Esquire, as emergency plenary guardian
of the estate of Mary Weaver pending a final hearing on this Petition with such
emergency guardian having such full powers and restrictions the Court deems proper;
3. Pursuant to 20 Pa.C.S.A. §5513 the Court find that the emergency
necessitating the filing of this Petition will continue beyond seventy-two (72) hours from
the date of any Emergency Order;
4. Pursuant to 20 Pa.C.S.A. §5513 the Court schedules a final hearing on or
within 23 days from the date of any Emergency Order; and
5. The Court appoint the Area Agency on Aging, in and for Cumberland
County, Pennsylvania as Permanent Plenary Guardian of the Person of Mary Weaver and
Roger Irwin, Esquire as Permanent Plenary Guardian of the Estate of Mary Weaver.

foregoing petition and on motion of the Area Agcncy on Aging, in and for Cumberland
County, Pennsylvania, through their Counsel, Anthony L. DeLuca, Esquire, it is
ORDERED AND DECREED that a Citation be awarded, directed to Mary Weaver to
show cause why emergency plenary guardians of her person and estate should not be
appointed, and why she should not be adjudged an incapacitated person and permanent
plenary guardians of her person and estate should not be appointed.
The time and place of hearing on the Petition for Appointment of Emergency
Plenary Guardians of the Person and Estate of the alleged incapacitated person are fixed

The Court finds that the following additional notice to others of the hearing on
appointment of emergency plenary guardians of the alleged incapacitated person is
feasible under the circumstances and directs that same be attempted to be made upon thc
following person in the following manner: Arthur Weaver, Russell Weaver, Paul
Weaver, Evelyn Johnson, Josephine Cook and Florence Warner by first class United
States mail.
The time and place of hearing on the Petition for Appointment of Permanent
Plenary Guardians of the Person and Estate of the alleged incapacitated person are fixed

AND NOW, this~ay of August, 2004, after a hearing, the Court finds that Mary
Weaver is an incapacitated person and the Area Agency on Aging, in and for Cumberland
County, Pennsylvania is hereby appointed Emergency Plenary Guardian of the Person of
Mary Weaver and Roger Irwin, Esquire is hereby appointed Emergency Plenary
Guardian of the Estate of Mary Weaver, pending a final hearing on this Petition, with
such Emergency Plenary Guardians having full power to place Mary Weaver in a nursing
home facility.
The Court further finds that the emergency necessitating the filing of this Petition
will continue beyond seventy-two (72) hours from the date of this Order and counsel for
Mary Weaver waives the requirement for filing a Petition to Extend upon the expiration
of the seventy-two (72) hour period of this Order.
A hearing on the issue of Permanent Guardianship is scheduled for Monday,

a heating, the Court finds, upon clear and convincing evidence, that Mary Weaver is an
incapacitated person in that she suffers from a mental impairment that prevents her from
receiving and evaluating information effectively and prevents her from formulating and
communicating decisions to such a significant extent that she is unable to manage her
financial affairs or meet essential requirements for her physical health and safety on a
daily basis.
The Court appoints the Area Agency on Aging, in and for Cumberland County,
Pennsylvania, as Permanent Plenary Guardian of the Person of Mary Weaver and Roger
Irwin, Esquire as Permanent Plenary Guardian of the Estate of Mary Weaver.

~n ~st 20, 2004 Judge Kevin Hess appointed the Cumberland County Office
~Agin~ergency Guardian of Person for Mary Weaver. Following this
~pointment, Ms. Weaver was transported from the Car[isle Regiona[ Medica[
@enter to the Manor Care Hea[th Services, Carlisle, PA where she was admitted.
On September 19, 2004 the final guardianship hearing was held with the
Cumberland County Office of Aging being appointed Guardian of Person and
Roger Irwin, Esq. being appointed Guardian of Estate.
Since being admitted to Manor Care, Mary Weaver adjusted quickly. She is
diagnosed with ambulation dysfunction, dementia, probably rheumatic arthritis,
depression, managed anemia and resolved malnutrition. When she initially came
to the home she was malnourished and weighed 113 pounds. She ate 100% of
her meals and was given extra portions when she asked for them. She currently
weighs 158 pounds and is on weight maintenance. She is able to do her own
personal care with supervision and cueing. A physical therapist worked with her
extensively and her range of motion has improved. She participates in the
activities she chooses. She especially likes singing and enjoys listening to the
radio. She likes to spend time in her room, holding her stuffed animals and
looking at magazines. The depression is being managed by medication and
seems to be stable. Mary has occasional verbal outbursts. Staff need only touch
her on the shoulder or arm to get her out of this state. Family had reported that
Mary seemed to have some type of mental illness from the time she graduated
from high school but was never officially diagnosed. She is rarely visited by family
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person for Mary Weaver. The Manor Care Home has
demonstrated an adequate quality of care for her medical and mental problems.
We believe, therefore, that Mary Weaver should continue to reside in that nursing
facility.

On August 20, 2004 Judge Kevin Hess appointed the Cumberland CountyOTflce at:
Aging Emergency Guardian of Person for Mary Weaver. Following this app6intme"{:
Ms. Weaver was transported from the Carlisle Regional Medical Center to the Ma'}Sr
Care Health Services, Carlisle, PA where she was admitted. On September 19, 2004
the final guardianship hearing was held with the Cumberland County Office of Aging
being appointed Guardian of Person and Roger Irwin, Esq. being appointed Guardian
of Estate.
Since being admitted to Manor Care, Mary Weaver adjusted quickly. She is diagnosed
with ambulation dysfunction, dementia, probably rheumatic arthritis, depression,
managed anemia and resolved malnutrition. When she initially came to the home she
was malnourished and weighed 113 pounds. She currently weighs 171 pounds and is
on weight maintenance. Over the past year Mary's verbal outbursts increased in
number and severity. She is being followed by a psychiatrist who currently has her on
20 mg of Celexa She is able to do her own personal care with supervision and cueing.
She participates in the activities she chooses but she also likes to spend time in her
room, holding her stuffed animals and looking at magazines. The activities she usually
attends involve music, either singing or listening to the radio. She has little interaction
with other residents. Her room was recently changed because a bed alarm was
installed on her roommate's bed and staff thought the loud noise might bother her and
cause an even more increase in her verbal outbursts. On my most recent visit, Mary
appeared to understand what I was saying to her and she was able to answer my
questions. The room change has not bothered her and she told me her favorite candy
was peanut butter cups so I will see that she gets some.
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person for Mary Weaver. The Manor Care Home has demonstrated
an adequate quality of care for her medical and mental problems. We believe,
therefore, that Mary Weaver should continue to reside in that nursing facility.

On August 20,2004 Judge Kevin Hess appointed the Cumberland County Office of
Aging Emergency Guardian of Person for Mary Weaver. Following this appointment,
Ms. Weaver was transported from the Carlisle Regional Medical Center to the Manor
Care Health Services, Carlisle, PA where she was admitted. On September 19, 2004
the final guardianship hearing was held with the Cumberland County Office of Aging
being appointed Guardian of Person and Roger Irwin, Esq. being appointed Guardian
of Estate.
Since being admitted to Manor Care, Mary Weaver adjusted quickly. She is diagnosed
with ambulation dysfunction, dementia, probably rheumatic arthritis, depression,
managed anemia and resolved malnutrition. When she initially came to the home she
was malnourished and weighed 113 pounds. She currently weighs 180 pounds and
her weight is stable. She is being followed by a psychiatrist because of her verbal
outbursts. He currently has her on 20 mg of Celexa. She is able to do her own
personal care with supervision and cueing. She requires 2 people to assist her for
transferring. She has had no skin breakdown. She participates in the activities she
chooses but she also likes to spend time in her room, holding her stuffed animals and
looking at magazines. She also likes snack time. The activities she usually attends
involve music, either singing or listening to the radio. She has little interaction with
other residents.
After checking with Roger Irwin, Esq. to make sure she had sufficient funds, the
Office of Aging set up burial arrangements with Hollinger Funeral Home. The bill was
sent to Mr. Irwin and was paid.
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person for Mary Weaver. The Manor Care Home has demonstrated
an adequate quality of care for her medical and mental problems. We believe,
therefore, that Mary Weaver should continue to reside in that nursing facility.

gastrointestinal reflux disease, coronary artery disease, Afib, diabetes, depression,
managed anemia and resolved malnutrition. When she initially came to the home she
was malnourished and weighed 113 pounds. She currently weighs 180 pounds and
her weight is stable. She is being followed by a psychiatrist because of her verbal
outbursts. He currently has heron 20 mg of Celexa and .5mg Risperdal. She is also
on 500 mg Metformin HCL for diabetes. She is able to do her own personal care with
supervision and cueing. She requires 2 people to assist her for transferring. Mary has
had a history of scratching herself, but it has become more of a problem. In the past
several months she has scratched her self open on her face, leg, and rectal area.
They have placed heron 2 mg of Gavatril to try to control this behavior. She
participates in the activities she chooses but she also likes to spend time in her room,
holding her stuffed animals and looking at magazines. She also likes snack time. The
activities she usually attends involve music, either singing or listening to the radio.
She has little interaction with other residents. She does respond appropriately to
simple direct communication.
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person for Mary Weaver. The Manor Care Home has demonstrated
an adequate quality of care for her medical and mental problems. We believe,

Aging the Emergency Guardian of Person for Mary Weaver. Following this appointment,
Ms. Weaver was transported from the Carlisle Regional Medical Center to the Manor
Care Health Services, Carlisle, PA where she was admitted. On September 19, 2004
the final guardianship hearing was held with the Cumberland County Office of Aging
being appointed Guardian of Person and Roger Irwin, Esq. being appointed Guardian of
Estate.
Mary has been diagnosed with dementia, post traumatic stress, contracture,
hallucinations, depressive disorder, anemia, rheumatoid arthritis, muscular atrophy,
primary cerebellar degeneration, amnesiac disorder, congestive heart failure, anxiety,
diabetes, hypertension, psychosis. This year the Koraskoff syndrome was added to the
list of diagnoses. When she initially came to the home she was malnourished and
weighed 113 pounds. She currently weighs 167 pounds and her weight is stable.
She is being followed by a psychiatrist because of her verbal outbursts. During these
outbursts Mary usually goes to her room. She is impossible to redirect during these
episodes and it seems she considers outside intervention as a threat. At times she yells
get away during these episodes.The Home, therefore, lets her to herself during these
episodes. Mary has a lot of stuffed animals and she has been observed role playing
with them and pretending to feed them.
Her medications are furosemide 40 mg for heart failure, Claritin-D for allergies,
acetaminophen 500mg for pain, metformin HCL 500 mg, for diabetes, risperdal 5mg for
behavior, ferrous sul 160 mg for anemia, glipizide 5mg for diabetes, citalopram HBR
40mg for depression, and gabitril 2 mg for dementia. She now needs assistance with
her activities of daily living such as bathing and dressing. She requires 2 people to
assist her for transferring. She is capable of feeding herself once her tray is set up for
her. Mary has had a history of scratching herself, but it has become more of a problem
recently. They have tried different lotions as well as allergy medications but it is still a
problem. She almost always as an area on the bridge of her nose scratched open. She
participates in the activities she chooses, mostly bingo and those related to music, but
she also likes to spend time in her room. She likes the daily snack time when she

usually takes potato chips instead of ice cream. She has little interaction with other
residents. She does respond appropriately to simple direct communication.
Mary continues to receive $30 from SSI and $15 from Medical Assistance each month.
With the approval of Mr. Irwin, her guardian of estate, we applied to become rep payee
and opened a checking account for her. A summary of the activity in this account is
attached, as well as a spread sheet representing the checkbook register. The only
expenditures were the purchase of the checks from the bank and some clothing
because she needed a larger size. Christmas presents were provided by volunteers of a
home health agency and we delivered these to the home and asked that she receive
them on Christmas.
Ms. Weaver is visited by the care manager who also attends the care plan meetings. In
addition to visiting her, the care manager reviews the medical record and discusses her
condition with the nursing staff. The nursing home staff updates the care manager
whenever there are concerns or medical problems.
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person for Mary Weaver. The Manor Care Home has demonstrated an
adequate quality of care for her medical and mental problems. We believe, therefore,
that Mary Weaver should continue to reside in that nursing facility.

On August 20, 2004 Judge Kevin Hess appointed the Cumberland County Office of
Aging the Emergency Guardian of Person for Mary Weaver. Following this appointment,
Ms. Weaver was transported from the Carlisle Regional Medical Center to the Manor
Care Health Services, Carlisle, PA where she was admitted. On September 19, 2004
:'~ , the final guardianship hearing was held with the Cumberland County Office of Aging
being appointed Guardian of Person and Roger Irwin, Esq. being appointed Guardian of
Estate.
Mary has been diagnosed with dementia, post-traumatic stress, contracture,
hallucinations, depressive disorder, anemia, rheumatoid arthritis, muscular atrophy,
primary cerebellar degeneration, amnesiac disorder, congestive heart failure, anxiety,
diabetes, hypertension, psychosis. Last year the Koraskoff syndrome was added to the
list of diagnoses. When she initially came to the home she was malnourished and
weighed 113 pounds. She currently weighs 167 pounds and her weight is stable.
She is being followed by a psychiatrist because of her verbal outbursts. She continues
to have occasional screaming episodes. The nurse stated that when she gets these
episodes she has been observed going into her room, taking out a stuffed monkey that
she has in one of her drawers. She started shaking it and saying things like "You lied to
me, mother. You told me it would be alright. You told me it would stop." She also self
mutilates by picking at sores on her face. About the time they get them to heal, she will
start picking at them. These behaviors seem to increase around holidays.
She needs assistance with her activities of daily living such as bathing and dressing.
She requires two people to assist her for transferring. She is capable of feeding herself
once her tray is set up for her. Mary has had a history of scratching herself, but it has
become more of a problem recently. She has little interaction with other residents. She
does respond appropriately to simple direct communication. If you ask her how she is
feeling she always replies, "Good."
She continues to have occasional screaming episodes. The nurse stated that when she

Mary is visited by an agency staff member who also attends the care plan meetings. In
addition to visiting her, the medical record is reviewed and her condition is discussed
with the nursing staff. The nursing home staff updates the agency whenever there are
concerns or medical problems.
Mary receives no pension or Social Security. She continues to receive $30 from SSI
and $15 from Medical Assistance each month. With the approval of Mr. Irwin, her
guardian of estate, we applied to become rep payee and opened a checking account for
her. A summary of the activity in this account is attached, as well as a spread sheet
representing the checkbook register. There were no expenditures made this year.
Monies saved will be used for funeral expenses. Christmas presents were provided by
volunteers of a home health agency and we delivered these to the home and asked that
she receive them on Christmas.
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person for Mary Weaver. The Manor Care Home has demonstrated an
adequate quality of care for her medical and mental problems. We believe, therefore,
that Mary Weaver should continue to reside in that nursing facility.

outbursts Mary had been observed going into her room, taking out a stuffed monkey
that she kept in her drawer. She would start shaking it and saying things like "You lied to
me, mother. You told me it would be alright. You told me it would stop."
Since the October 2011 Annual Report, she began to experience symptoms. of
pneumonia in January of this year and was taken to the Carlisle Regional Medical
Center. She returned a few days later. In early February she was moved from locked
dementia unit because,she no longer .needs to be there. She was placed in a regular
room. In early March she tested positive for C-Dill and a week later she was placed on
the Hospice Program. She declined dramatically in the next few days. Her blood
pressure fell and her kidneys began to fail. She passed away on March 15, 2012,
Hollinger's Funeral Home in Mt. Holly Springs handled the cremation. Three care
managers from Cumberland County Aging attended the graveside service. Except for
the funeral director, we were the only ones in attendance.
Mary's only income was $30 a month from Social Security and $1 % a month of
Department of Welfare. Her nursing home stay was covered by Medical Assistance.
