BITTINGER, Defendant IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA No. CIVIL ACTION - LAW COMPLAINT 1. The Plaintiff is an adult individual residing at 633 Walnut Street, Lebanon, Pennsylvania 17042. 2. The Defendant is an adult individual residing at 11 Run Road, Carlisle, Pennsylvania 17013. 3, The facts and occurrences hereinafter related took place on or about August 17, 2003 on North West Street in the Borough of Carlisle. 4. At the time and place aforesaid, Plaintiff was the owner and operator of a 1994 Pontiac sedan which was then and there traveling north on North West Street. 5. At the time and place aforesaid, Defendant was the owner and operator of a vehicle traveling south on North West Street when she attempted to make a left hand turn directly in front of Plaintiff's vehicle causing a collision and the losses hereinafter set forth. 6. The aforesaid accident and the damages resulting therefrom were caused by the negligence of the Defendant in that she: a) failed to keep a proper lookout for other vehicles; b) failed to yield the right-of-way to Plaintiff's vehicle; and c) attempted to make a left hand turn when it was not safe to do so. 7. Solely as a result of Defendant's negligence, Plaintiff sustained damages totaling THREE THOUSAND THREE HUNDRED SEVENTY-SIX and 06/100 ($3,376.06) DOLLARS for repair of his vehicle and the cost of a rental vehicle while repairs were being made.
