COMPLAINT
1. Plaintiff Nationwide Mutual Insurance Company (herein "Nationwide
Insurance Company") is an insurance carrier licensed and authorized to
conduct business in the Commonwealth of Pennsylvania and having as one of
its principal places of business the above captioned address.
2. Tammy L. Champaign an adult individual insured with Plaintiff Nationwide
Insurance Company under a personal automobile policy on 11/23/2009.
3. Defendant Dayton E. Baltimore Jr is an adult individual residing at the above
captioned address.
4. On or about 11 /23/2009, Plaintiff Nationwide Insurance Company insured
Tammy L. Champaign with personal automobile policy, policy number
5837E148381, said policy carrying with same UMBI coverages.
5. On or about 1] /23/2009 at or near the intersection of S. Enola Rd Near W.
Pine St. East Pennsboro Twp., Cumberland County, PA, Defendant Dayton E.
Baltimore Jr was negligently operating a 2000 Ford F-150 bearing PA tag
YST 1093 when suddenly and without warning the Defendant Dayton E.
Baltimore Jr.'s vehicle struck Plaintiffs insured who was walking across the
roadway.
6. As a result of the violent collision the Plaintiff's insured sustained bodily
injuries to and about her person which required medical attention and
treatment.
7. The negligence of the Defendant consisted of:
a) failing to yield right of way;
b) being inattentive;
c) striking another motor vehicle lawfully upon the roadway;
d) failing to give due regard to the rights, safety point and position of
Plaintiff's insured's vehicle;
e) failing to maintain control of said vehicle so as to be able to stop within the
assured clear distances ahead;
f) improper turning methods,
g) failing to give proper signal
h) improper methods of passing:
i) striking a pedestiran
j) other such negligence that may be developed through continuing discovery
and trial of this matter.
8. The aforesaid collision resulted solely from the negligent acts and/or failure to
act on part of Defendant named herein and was due in no manner whatsoever
to any act and/or failure to act on part of Plaintiff's insured.

9. As a result of the aforesaid collision The Plaintiff Tammy L. Champaign
sustained injuries to and about their persons requiring medical attention and
treatment, said injuries included but were not limited to pelvic fracture,
bruising and contusions.
10. As a result of the aforesaid policy of insurance, Plaintiff. Nationwide
Insurance Company settled the UMBI claims of Plaintiff Tammy L.
Champaign in the amount of $25,000.00 (representing policy limits and fair
and reasonable reimbursement for said injuries).
11. Pursuant to the aforesaid policy of insurance, Nationwide Insurance Company
is subrogated to Tammy L. Champaign for this loss.
WHEREFORE, Plaintiffs demand judgment against the Defendant in the amount
of $25,000.00 together plus costs, interest and such other relief this Court finds
equitable and just.

Complaint and Notice according to law.
