STIPULATION AGAINST LIENS
THIS AGREEMENT made this 14K day of 2011, by
and between Claypool III/Tiday LLC, hereina er referred to as
Contractor,
Edwin L. Deaton and Cheryl L. Deaton, husband and wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Middlesex Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot 120,
Meadowbrook Farms, Phase VII, 54 Country Side Drive, Carlisle, PA
17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situated in Middlesex Township, Cumberland
County, PA, being Lot 120, as shown on a plan entitled, "Meadowbrook Farms,
Final Subdivision Plan Phase VII", dated April 10, 2008, by PennTerra
Engineering, Inc., State College, PA, being bounded and described as follows:
BEGINNING at an iron pin being an easterly corner of Lot 119 and lying in a
westerly right of way line of Country Side Drive 50 feet right of way; thence along
said right of way South 20 degrees 40 minutes 58 seconds East 133.86 feet to an iron
lying along said right of way and being a northerly corner of Lot 121; thence along
said Lot South 69 degrees 19 minutes 02 seconds West 154.34 feet to an iron pin
being a westerly corner of said lot, a northerly corner of Lot 117 and an easterly
corner of Lot 118; thence along Lot 118 North 10 degrees 23 minutes 26 seconds
West 136.04 feet to an iron pin being a northerly corner of said lot and a southerly
corner of Lot 119; thence along Lot 119 North 69 degrees 19 minutes 02 seconds
East 130.03 feet to an iron pin, being the Place of BEGINNING.
Containing 0.437 ACRES.
Subject to a 10 foot wide utility and sidewalk easement along its street front.
BEING part of the same premises which Mary Verdelli by deed dated 1/4/89 and
recorded 1/5/89 in Deed Book 33 T, Page 296, granted and conveyed unto Pamay
Development Co., Inc.
