THIS AGREEMENT MADE THE 9TM day of August, 2004, by and between
HARMAX Construction, Harry M. Morret, Owner, 499 Zion Road, Carlisle, Pennsylvania,
hereinafter referred to as Contractor,
AND
Niven J. Baird and Joan G. Baird
hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a one-floored addition to the
single family residence on that certain lot of ground known as: 1252 Holly Pike, Carlisle, South
Middleton Township, Pennsylvania.
NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for and in consideration of the sum of One and 00/100 Dollar ($1.00) to Contractor in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned
in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through
or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said construction and the lot of ground appurtenant thereto for
or on account of any work done or mater/als furnished by them or any of them under said
contract or oth~nvise, for, towards, in, or about the erection and construction of the said one-
floored addition to the residenc& on the lot above described, and the said Contractor, them
themselves, their subcontractors and others under them hereby expressly waive and relinquish the
right to have, file, and maintain any mechanic's liens or claims against the said construction or
any of it or them, and agree that.ti'tis instrument, waiving the fight of lien, shall be an independent
covenant.
