PETITION FOR APPOINTMENT OF ( UARDIA;'
NOW comes petitioner, Linda L. Wilson, by her attorney, Nathan C. Wolf,
Esquire, and presents this petition for appointment of guardian of the person of Fred L.
Wilson, an alleged incompetent, representing as follows:
1. Petitioner is Linda L. Wilson, an adult individual residing at 85 Appalachian
Drive, Carlisle, Cumberland County, Pennsylvania 17013.
2. The alleged incapacitated person is Fred L. Wilson, born March 31, 1935
(age 68 years), residing at 85 Appalachian Drive, Carlisle, Cumberland County,
Pennsylvania 17013.
3. The alleged incapacitated person has been mentally incapacitated since
Monday, April 14, 2003 and has lived at his address with petitioner, his wife, since 1974.
According to his physician, Fred's prognosis is guarded and he is suffering from
paralysis secondary to a severe stroke. He is incapable of caring for his own basic
needs, both in his personal finances and physical needs, and is unable to properly
follow the directions of his physicians for his own health care. He presently has a
serious medical condition requiring serious medical attention for the foreseeable future.
This condition renders the alleged incapacitated person incapable of executing a power
of attorney, authorizing his wife to conduct business on his behalf and to manage the
household finances and to access the only sources of family income. (See letter from J.
Craig Jurgensen, M.D., attached hereto as Exhibit "A").
4. The following persons are the alleged incapacitated person's next-of-kin:
Linda L. Wilson (of Carlisle, Pennsylvania, petitioner and wife of the alleged
incompetent), Lorrie D. Perry (of Chandler, Arizona, daughter of the alleged
incapacitated person), Scott A. Wilson (of Carlisle, Pennsylvania, son of the alleged
incapacitated person), Tawnya D. Wilson (of Carlisle, Pennsylvania, daughter of the
alleged incapacitated person), and Kelli D. Fowler (of Fayetteville, North Carolina-
daughter of the alleged incapacitated person).
5. The consent of the petitioner as his next-of-kin is incorporated herein and
attached hereto as Exhibit "B".
6. Petitioner has no knowledge of any other Court within this Commonwealth
which has appointed a guardian for the alleged incapacitated person.
7. The alleged incapacitated person's assets include an investment account
held with Gibbs Financial Services, a pension plan administered by SEI Private Trust
Company, a tenancies by the entireties interest in the marital home at 85 Appalachian
Drive, Middlesex Township, Cumberland County, Pennsylvania, and a checking account
held at M & T Bank. His income is limited to pension, investment and social security
distributions on a monthly basis, but the distributions are directly deposited into the M &
T Bank checking account.
8. Petitioner has no interest adverse to the alleged incapacitated person and
has agreed to act as guardian if this Honorable Court shall so appoint.
WHEREFORE, petitioner respectfully requests this Honorable Court set a
hearing at which the averments of this petition may be documented and the
appointment of petitioner as guardian for the alleged incapacitated person may be
considered, with notice thereof to be given to such persons as this Court may direct.
Petitioner further requests that a guardian ad litem be appointed to act for the alleged

I, J. Craig Jurgensen, M.D., being duly sworn according to law, depose and say
that I am a licensed physician in the Commonwealth of Pennsylvania employed by
Belvedere Medical Corporation. I have examined the alleged incapacitated person,
Fred L. Wilson, with care and diligence. Based upon said examination and observation,
I am of the opinion that he is currently incompetent to manage his own affairs and that
there is no expectation of his immediate recovery within a reasonable degree of medical
certainty. In addition, it is my opinion that no useful purpose would be served by Mr.
Wilson's appearance at a hearing to adjudicate his competency and, in fact, attendance
at such a hearing could well be adverse to his well-being.

CITATION WITH NOTICE
A petition has been filed with the Court to have you declared an Incapacitated Person. If the
Court finds you to be an Incapacitated Person, your rights will be affected, including our right to manage
money and property and to make decisions. A copy of the petition which has been filed by NATHAN C
WOLF, ESQUIRE is attached.
You are hereby ordered to appear at a heating to be held in Court Room No. 4, Cumberland
County Courthouse, Carlisle, Pennsylvania, on MAY 1 ,2003, at 1:30 P.M. to tell the
Court why is should not find you to be an incapacitated Person and appoint a Guardian to act on your
behalf.
To be an incapacitated Person means that you are not able to receive and
effectively evaluate information and communicate decisions and that you are unable to
manage your money and/or other property, or to make necessary decisions about where
you will live, what medical care you will get, or how your money will be spent.
At the hearing, you have the right to appear, to be represented by an attorney, and
to request a jury trial. If you do not have an attorney, you have the right to request the
Court to appoint an attorney to represent you and to have the attorney's fees paid for you
if you cannot afford to pay them yourself. You also have the right to request that the
Court order that an independent evaluation as to your alleged incapacity.
If the Court decides that you are an Incapacitated person, the Court may appoint a
Guardian for you, based on the nature of any condition or disability and your capacity to
make and communicate decisions. The Guardian will be of your person and/or your
money and other property and will have either limited of full powers to act for you.
If the court finds you are totally incapacitated, your legal rights will be affected
and you will not be able to make a contract or girl of your money to other property. If the
court finds that you are partially incapacitated, your legal rights will also be limited as
directed by the Court.
If you do not appear at the hearing (either in person or by an attorney representing you)
the court will still hold the hearing in your absence and may appoint the Guardian requested.
