MOTION FOR DECLARATION OF OWNERSHIP AND NOW comes the Charles W. Wadsworth, who, Motions this Honorable Court for declaration of Ownership of a 1971 Chevrolet El Camino (VIN: 136801 B229496) and in support thereof respectfully avers: 1. Charles W. Wadsworth is an adult individual current residing at 639 B Street, Enola, Cumberland County, Pennsylvania 17025. 2. Charles W. Wadsworth is requesting a Declaration of Ownership of a 1971 Chevrolet El Camino (VIN: 1368016229496) (hereinafter referred to simply as the "El Camino") which Mr. Wadsworth obtained from Mr. Kurt Kilby on August 19, 2004. (A true and correct copy of the Bill of Sale from Mr. Kilby to the Petitioner, Charles W. Wadsworth is attached hereto, made part hereof and marked as Exhibit "A") 3. Upon information and belief, the last titled owner of the El Camino was Diana Jean Bostwick now known as Diana Jean Steele. 4?# /i. 16 4. The undersigned caused a search of the records to be conducted by the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles on February 16, 2011 in which the Bureau returned a finding that Ms. Steele is still the owner of record for the El Camino however the official record has been purged as the El Camino's registration has not been renewed since approximately 1995. (A certified original of the February 16, 2011 Report is attached hereto, made part hereof and marked as Exhibit "B") 5. On December 22, 2010, the undersigned contacted Matthew Haeckler, Esquire, Assistant Counsel for Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles who stated that Penn Dot has no interest in these matters other than the determination of who the owner of the vehicle is. 6. There is no indication that there is anyone besides the Charles W. Wadsworth who claims ownership of this El Camino. 7. Charles W. Wadsworth is unable to obtain a Certificate of Title from the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles because there exists no record of a Certificate of Title with the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles for this particular vehicle. 8. Further, Mr. Wadsworth has been unable to contact Ms. Steele with regards to her assistance in Mr. Wadsworth securing a title to this vehicle from Penndot. 9. Mr. Wadsworth made several attempts to contact Ms. Steele after purchasing the vehicle in 2004 and believes he may have spoken to her at one point, but the person he believes to have been her on the phone did not identify herself as such but simply stated that Ms. Steele did not wish to be found due to personal reasons. WHEREFORE, Charles W. Wadsworth, respectfully request that this Honorable Court declare that Charles W. Wadsworth is the owner of the 1971 Chevrolet El Camino (VIN: 136801 B229496).
