WAIVER OF RIGHT TO FILE LIEN - SEPARATE STIPULATION OF
MECHANICS' LIENS
WHEREAS, McCOY BROTHERS, INC., a Pennsylvania business corporation, party
of the first part, hereinafter called "Contractor", has entered into a Construction Agreement with
YELLOW BREECHES E.M.S., INC., party of the second part, hereinafter called "Owner", to
provide materials and perform labor necessary for the renovation and addition to Owner' existing
structure with accessories thereto upon the premises described as follows:
BEING a combination of Lot 1-A and Parcel No. 2 as depicted on the Preliminary/Final
Subdivision Plan for Hempt Brothers, Inc. as recorded in Cumberland County Plan Book
66, page 54, and also being the same premises more fully described in the Deed to
Owners recorded in Cumberland County Deed Book 236, page 957, further identified as
Tax Parcel No. 40-31-2185-003 and commonly known as 233 Mill Street, Mount Holly
Springs, Cumberland County, Pennsylvania (the"Premises").
NOW THEREFORE, it is stipulated and agreed by and between the said parties, as part
of the Construction Agreement for the consideration therein set forth, that neither the
undersigned Contractor or any sub-contractor or materialman, nor any other person furnishing
labor or materials to said Contractor under the Construction Agreement shall file a lien,
commonly known as a mechanics' lien, for work done or material furnished to said Premises or
any part thereof.
This Stipulation is made and intended to be filed with the Prothonotary of Cumberland
County in accordance with the requirements of the laws of the Commonwealth of Pennsylvania.
The undersigned representative of the Contractor confirms that he has the authority on
behalf of the limited liability company to execute this Stipulation on its behalf.
IN WITNESS WHEREOF, the parties hereto have caused this document to be executed
the 0 t 4 T day of July, 2011 intending to thereby legally bind themselves, their
representatives, successors and assigns.
