This instrument is executed this 20' day of July, 2011, by HUGHES CONTRACTING, INC.
("Contractor";) in favor of JUSTIN M. OVER AND JACEE L. OVER ("Owners")
Whereas, Owners are about to execute contemporaneously herewith, a contract with
Contractor for the erection of a single family dwelling upon a lot of land situate in West Pennsboro
Township, Cumberland County, Pennsylvania, having an address of 113 McAllister Church Road,
Carlisle, PA 17015, and a parcel number of 46-08-0583-163, and described in a certain Deed
recorded at Book 184, Page 771, more fully described as follows:
ALL that certain tract of ground, situated in West Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point in the center of the public road leading from Elliottson to McAllister
Church; thence along land of Frank Hockenberry, North 60 degrees 15 minutes East a
distance of 194 feet, more or less, to a stake; thence along lands of the grantors herein, South
14 degrees East a distance of 150 feet to a stake; thence by other land now or formerly of
Floyd E. Morrison and Roma E. Morrison, South 61 degrees 45 minutes West a distance of
210 feet to a point in the center of the aforesaid public road; thence by the center of the said
public road, North 7 degrees 30 minutes West a distance of 150 feet to the point of
beginning. Containing 30,300 square feet, more or less.
SUBJECT TO THE FOLLOWING BUILDING AND USE RESTRICTION:
No building or part thereof shall be erected within 40 feet of the center of the public road
leading from Elliottson to McAllister Church.
BEING THE SAME PREMISES WHICH Marlin L. Barrick, Anna Mae Wickard and Paul
L. Barrick, Executors of the Estate of Leroy A. Barrick, by Deed dated August 27, 1988, and
recorded September 1, 1998, in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania in Deed Book 184, Page 771, granted and conveyed to Floyd E.
Morrison and Roma E. Morrison, husband and wife.

Now, July 20, 2011, at the time of and immediately before the execution of the construction
contract aforesaid, and before any authority has been given by the said Owners to the said Contractor
to commence work on the said building, or purchase materials for the same, in consideration of the
Owners making of the said contract with Contractor, and intending to be legally bound hereby, it
is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
