ANSWER
AND NOW, comes the Cumberland County Board of Assessment Appeals and the County
of Cumberland, by Stephen D. Tiley, Assistant Cumberland County Solicitor for tax matters, and
files this Answer to the "Appeal from the Cumberland County Board of Assessment" filed in the
above captioned matter, of which the following is a statement:
1. Admitted.
2. Admitted.
3. Admitted. By way of further Answer, the decision of the Board reducing the value
to $307,160.00 is irrelevant to the within proceeding. An appeal to Court is di novo, and the
assessment appealed is the original assessment of $373,290.00.

5(A). Denied. While Appellant's figures are correct, Appellant is comparing year 2004
countywide reassessment figures to the year 2000 base year figures, and such a comparison is
irrelevant to this proceeding. The sole issue before the Court is the fair market value of the
property as of the date the appeal was filed.
5(B). Denied. The averments of this sub-paragraph set forth a conclusion of law to which
no responsive pleading is required. By way of further Answer, the assessment currently before the
Court is $373,290.00, not $307,160.00.
5(C). Denied. The averments of this sub-paragraph set forth conclusions of law to which
no responsive pleading is required. By way of further Answer, uniformity is determined by the
entire taxing district, not selected, neighboring, properties.
5(D). Denied. The averments of this sub-paragraph sets forth conclusions of law to which
no responsive pleading is required.
NEW MATTER
6. Appellant's "Appeal from the Cumberland Country Board of Assessment" is
unverified. However, the Respondent, Cumberland County Board of Assessment Appeals,
declines to ask that the appeal be stricken and will allow the appeal to be heard by the Court.
WHEREFORE, Respondent, Cumberland County Board of Assessment Appeals and
County of Cumberland, prays Your Honorable Court for an Order fixing the fair market value of
the subject property at $373,290.00 or such other amount as the Court may deem just and proper.
