New Cumberland Federal Credit Union ("NCFCU") has a principal place of business as listed above and is qualified to do business in the Commonwealth of Pennsylvania. 2. Thomas Griffith, Jr. ("Griffith") is an individual with a last know address as listed above. 3. On or about September 26, 2007, Griffith applied for a Visa credit card through NCFCU, which was approved with a credit limit of $13,000.00. A true and correct copy of the Visa Credit Card Application is attached as Exhibit 1. 4. Under ¶ 7 the terms of the Visa Credit Card Agreement (the "Agreement'), Griffith was obligated to remit to NCFCU the minimum payment stated on the monthly statement within 25 days of the statement closing date. A true and correct copy of the Agreement is attached as Exhibit 2. 5. Pursuant to 1 6 of the Agreement, failure to remit the required monthly payment when due would result in a late payment fee of $15.00 being assessed against the account. 6. Under ¶ 10 of the Agreement, a default occurs if Griffith, inter alia, fails to remit the required monthly payment when due. 7. Pursuant to ¶ 6 of the Agreement, NCFCU is entitled to receipt of collection costs and attorney's fees equal to 20 percent of the total outstanding balance. 8. Griffith failed to remit the minimum monthly payment that became due with the statement of March 16, 2011. 9. Griffith's failure to remit the required minimum monthly payment subsequent to March 16, 2011, constitutes a default under the Agreement. 10. As a result of Griffith's default, NCFCU has suffered damages, as of June 9, 2011, in the total amount of $12,491.40, including a principal balance of $11,152.00, late fees totaling $15.00, interest of $188.82, $1,135.58 in collection expenses, and per diem interest of $2.11 from June 9, 2011. WHEREFORE, NCFCU respectfully requests that judgment be entered in favor of NCFCU and against Griffith for $12,491.40, plus interest of $2.11 from June 9, 2011, forward and any other relief which this Honorable Court deems necessary.
