BASTIAIR, owners, of land or lands in Monroe Township, Cumberland County, Pennsylvania, intends to enter into a certain 'contract', with the C. Antractor, WHEATLAND CUSTOM. HOMF..S, INC., of ~,~a~.f~~,forthe Construction cfa rl~ ~li~v'~ ~a,e//fl~n on land, situate in Monroe Township, Cumberland County, Pennsylvania, owned~y ROBERT E. BASTIAN and AUDREY L. BASTIAN, the Owner, more particularly described as follows: SEE ATTACHED FOR DEED DF. SCRIPTION AND NOW, the/.~ day of May, 2001, in consideration of the making of said contract with the Contractor, WHEATLAND CUSTOM HOMES, INC., the Contractor ha~ covenanted, promised and agreed that no mechanic's or materialmen's lien shall be filed or maintained against the estate or title of Owner, ROBERT E. BASTIAN AND AUDREY L. BASTIAN, in the property or any part thereof, or thc appurtenances thereto, either by itself or anyone else acting or claiming through or under it for or on account of any work, labor or materials supplied in the performance of the work under the contract or under any supplemental contract for extra work. NOW. THEREFORE, in consideration of the contract and the covenants of owner contained therein, and the sum of d~i/~:: r~.~ ~ ($ ~', ,~a ~ Dollar paid in hand to Contractor the receipt and sufficiency of which are hereby acknowledged and intending to be legally bound hereby: Contractor, for itself and anyone else acting or claiming through or under it, does hereby waive and relinquish all right to file a mechanic's or materiaimcn's lien or notice of intention to file any lien and does hereby covenant, promise and agre~ that no mechanic's or materialmen's llen or llen o£any kind whatsoever shall be filed or maintained against the estate or title of Owner in the property or the appurtenances thereto, by or in the name of the Contractor, or subcontractor, materialman, or laborer acting or claiming through or under for work done or material furnished in connection with the contract or by any other party acting through or under them or any of them for and about tile property or any part of it. This agreement waiving the right of lien ~ai] be an independent covenant by Contractor and shall operate and be effective as well with re, peet to work done and material furnished under any supplemental contract for extra work in connection with the above described project on thc property to the sam9 extent as any work or labor done and materials furnished under the contract.
