CIVIL ACTION/MORTGAGE FORECLOSURE
Plaintiff is M&T Bank, duly organized and doing business at the above-captioned address.
2. The Defendant is Daniel J. Buchan, who is the mortgagor and real owner of the mortgaged
property hereinafter described, and his/her last-known address is 226 Conway Street, Carlisle, Pennsylvania
17013.
3. On September 30, 2003, Daniel J. Buchan made, executed and delivered a mortgage upon
the premises hereinafter described to Mortgage Electronic Registration Systems, Inc., acting solely as a
nominee for M&T Mortgage Corporation which mortgage is recorded in the Office of the Recorder of
Cumberland County in Mortgage Book 1838, Page 3652.
4. On October 11, 2010, the aforesaid mortgage was thereafter assigned by Mortgage Electronic
Registration Systems, Inc., acting solely as a nominee for M&T Mortgage Corporation to M&T Bank, by
Assignment of Mortgage, recorded in the Office of the Recorder of Cumberland County in Assignment of
Mortgage Instrument Number 201028956.
5. The premises subject to said mortgage is described in the legal description attached as
Exhibit "A" and is known as 226 Conway Street, Carlisle, Pennsylvania 17013.
6. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due January 13, 2011 and each month thereafter are due and unpaid, and by the terms of said
mortgage, upon default in such payments for a period of one month, the entire principal balance and all
interest due thereon are collectible forthwith.
7. The following amounts are due on the mortgage:
Principal Balance $ 108,314.01
Interest through June 1, 2011 $ 2,593.73
(Plus $16.84 per diem thereafter)
Attorney's Fee $ 1,250.00
Late Charges $ 151.76
Corporate Advance $ 178.50
GRAND TOTAL $ 112,488.00
8. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and
notice required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter
13, et seq., commonly known as the Combined Notice of Delinquency has been sent to Defendant by regular
mail with a certificate of mailing and by certified mail, return receipt requested.
WHEREFORE, Plaintiff demands in rem Judgment against the Defendant in the sum of $112,488.00,
together with interest at the rate of $16.84 per diem and other costs and charges collectible under the
mortgage and for the foreclosure and sale of the mortgaged property. .

ALI. THAT CERTAIN lot or parcel of ground situ.te in the Borough of Carlisle, Cumberland County,
Pennsylvania, being located on the West side of Con,va) Street as indicated on the Plot of the Mooreland
Land Company, said Plot being duly recorded in tiz Office of the Recorder of Deeds in and for said
Cumberland County, and having a frontage on said Stl eet of forty (40) feet and running back the same width
one hundred twenty (120) feet to an alley, and boun(.ed on the South by property formerly of Gertrude L.
Springer, and on the North by an Alley, and being des-ribed on said Plot as Lot No. 120.
HAVING THEREON ERECTED a two-story frame dwelling house, known as and numbered 226 Conway
Street, Carlisle, Pennsylvania.
This lot is sold subject to the Plan of said Mooreland Land Company duly recorded as aforesaid, and also the
restrictions as attached to said plot and made a part thereof.
BEING the same premises which Farmers Trust Company, Executor of the Last Will and Testament of
Miriam Moody, Deceased, by its Deed dated and recorded July 10, 1990 in Cumberland County,
Pennsylvania, Deed Book Q, Volume 34, Page 1124, granted and conveyed unto James E. Trinnaman.
The said June B. Trinnaman joins in this conveyance t i transfer any right, title or interest she may have in said
property by virtue of her marriage to James E. Trinna man.
